9. On March 4, 2010, Officer Gregory researched city records and consulted with the City's <br /> building division to confirm the necessary permits have not been issued. (Testimony of <br /> Officer"Gregoiy) <br /> 10. On April 7, 20 10, the City issued the Respondents a Violation Citation for the following <br /> conditions: Junk, trash, commercial sign, window blinds, salvage materials, a pile of <br /> dead vegetation, plant containers, boxes, appliances and electronics, and other similar <br /> items discarded on the property, accessory structure being occupied as a dwelling, and <br /> construction without permits. The Respondents were duly notified of these conditions <br /> via certified return receipt mail and first class mail on April 7, 2010. (Exhibit 4, <br /> Violation Citation and mail receipt.) <br /> 11. On April 28, 2010 the Violation Citation was posted on the primary residence and <br /> served to Crystal-lea Perry, Respondent Adam Perry's sister (Exhibit 5a and. 5b, <br /> declaration's of service and Exhibit ##2p and 2y photos of posted Violation Citation.) <br /> 12. On May 11, 2010 Officer Gregory observed and took photos of discarded junk and <br /> debris, broken and discarded furniture, discarded fencing materials, plywood over a <br /> living room window and plywood over the bathroom window. (Exhibit In-.7h,photos <br /> taken.May 11, 2010) <br /> 13. She also researched City permit records and consulted with the City's building division <br /> on May 11, 2010, and confirmed there were no permits on file for the property. <br /> (Exhibit 9,printout of perna.it histor},for the property) <br /> CONCLUSIONS OF LAW <br /> Based on the above endings, the Examiner makes the following conclusions of law: <br /> 1. Everett Municipal Code 8.20.020 states; <br /> No person owning, leasing, renting, occupying or having charge of possession of any <br /> property I the city, including vacant lots, shall maintain or allow to be maintained on <br /> such property except as may be allowed by any other city ordinance ally of the <br /> following conditions visible from any public street, alley or other public or private <br /> property; <br /> (A)Junk, trash, litter, boxes, discarded lumber, salvage materials or other similar <br /> materials in any front yard, side yard, rear yard or vacant lot; <br /> (C)Broken or discarded fiirniture, household equipment and furnishings in any fi•ont <br /> yard, side yard, rear yard or vacant lot; <br /> (E)Dead, decayed, diseased, noxious or hazardous trees, or vegetation or any <br /> vegetation (not'including vegetation located in flower beds) taller than forty-two <br /> inches high or grass taller than twelve inches in height in any front yard, side <br /> yard, real-yard or vacant lot; <br /> t <br />
