CITY OF EVERETT <br /> RESOLUTION NO. , 9� <br /> A Resoultion of the Everett City Council Amending the Land Use <br /> Map Designation of the Everett General Plan for the west side <br /> of the 1800 Block of McDougall Avenue. <br /> WHEREAS, Broadway Hardware has made application to amend the <br /> General Plan land use designation of the west side of the 1800 <br /> block of McDougall Avenue from "Single Family Detached, 5 to 10 <br /> Dwellings per Gross Acre" to "Highway Cglnmercial" ; and <br /> WHEREAS, Broadway Hardware has also made application to rezone <br /> a portion of said block from R-2 Single Family Medium Density <br /> to B-2 Community Business for the purpose of constructing a <br /> parking lot; and <br /> WHEREAS, the Planning Commission has held a public workshop and <br /> a public hearing to take public testimony on the proposed <br /> requests and to consider General Plan policies which are <br /> relevant to the proposal; and <br /> WHEREAS, the Planning Commission has determined that the <br /> proposal could have detrimental impacts on the adjoining <br /> residential area to the east unless certain limitations and <br /> adequate conditions are applied which will promote land use <br /> compatibility; and <br /> WHEREAS, the zoning code provides for a "performance agreement" <br /> rezone procedure which allows the City and an applicant to <br /> enter into an agreement that will assure that properties <br /> proposed to be rezoned will be developed in accordance with <br /> specified term which are used to promote land use <br /> compatibility; and <br /> WHEREAS, the applicant has agreed to limit the use and <br /> development of the subject properties in order to reduce the <br /> potential impacts of rezoning upon the residential area to the <br /> east of the subject properties, and <br /> WHEREAS, the Planning Commission has recommended that the City <br /> Council approve the requested amendment to the Land Use Map of <br /> the Everett General Plan, and that the intent of said amendment <br /> be implemented through a Performance Agreement Rezone; and <br /> WHEREAS, the City Council finds the following: <br /> 1 . The proposed change to the Land Use Map is appropriate <br /> because existing commercial zoning and commercial land uses <br /> established within and immediately adjacent to the subject <br /> area have already significantly encroached into the <br /> immediate residential block. <br />
