General Provisions - Chapter 5.04 - Licenses <br /> The Findings of Facts and Conclusions as set forth in the January 12, 1990, <br /> decision remain effective. The following Findings of Facts pertain to the <br /> information as provided at the February 22, 1990, hearing: <br /> FINDINGS OF FACTS <br /> 1. The Applicant submitted that he operates a small business and it is his <br /> intent to use the subject property in conjunction with the small <br /> business. In addition, it is his intent to have three units of the <br /> structure be converted into living units. <br /> 2. The Applicant submitted that since 1979 he has owned a house across the <br /> street from the subject property, and during this time he observed the <br /> activity at the site which was a commercial activity done in conjunction <br /> with a neon sign business. His observations included: the loading and <br /> unloading of signs; the repair of trucks; the instruction of neon use <br /> and signage; and other commercial activity relating to the neon <br /> business. <br /> 3. The Applicant submitted that the previous owner of the subject property <br /> had employees at the subject property. <br /> 4. The Applicant submitted that based on the fact that employees were at <br /> the subject property and commercial activity occurred thereon, the use <br /> was for a commercial enterprise. <br /> 5. Testimony was received from a neon tube vendor who was a former employee <br /> of Ace Neon. The employee (Rodney Countryman) submitted that he worked <br /> at the subject property for a number of years and his work included <br /> loading and unloading of vehicles and other activities related to the <br /> neon business. <br />
