I <br /> gross acre, and all density designations on the <br /> zoning map should be in dwelling units per net acre <br /> as defined in the zoning code. <br /> The Zoning Code in effect when the application was <br /> submitted did not include a definition of "net density" and <br /> "net density" was not defined in the General Plan. The <br /> General Plan glossary includes definitions of gross and net <br /> acreage; however, those definitions are for informational <br /> purposes and were not adopted by Planning Commission and City <br /> Council . The definition of gross acreage states that it <br /> includes dedicated roads, parks and public facilities; while <br /> the definition of net acreage would exclude dedicated roads, <br /> I <br /> parks and public facilities. Testimony was received at the <br /> public hearings that environmentally sensitive areas and <br /> private roadways should be excluded from the site acreage in <br /> determining net density. <br /> It has been the City's practice when determining the <br /> density for apartment projects under the old zoning code to <br /> include all of the area within the property lines and to not <br /> exclude environmentally sensitive areas. The zoning code in <br /> effect at time of application for the proposal allows the <br /> transfer of development to usable portions of the site in <br /> multiple family areas and this has been done on sites <br /> throughout the City . The Zoning Code provides indirect <br /> limitations on transferring development to buildable portions <br /> of a site due to requirements for the provision of parking, <br /> recreation facilities, setbacks, and height limits. The EIS <br /> for the Merrill Creek proposal included the identification and <br /> analysis of environmentally sensitive areas; and conditions in <br /> the concomitant agreement state that development is not <br /> permitted in those areas, with limited exceptions. <br /> In calculating gross acreage, the Merrill Creek proposal <br /> 1 included the area within the property lines.
