School District prior to issuance of occupancy permits for the <br /> first phase of development. The Mukilteo School District <br /> stated that this is fair mitigation of the impacts generated <br /> by the proposal . In addition, the Applicant also offered a <br /> donation to the Mukilteo School District of 3 .9 acres of <br /> property as additional mitigation for use as a school site. <br /> A condition requiring the mitigation is included in the <br /> concomitant agreement. The condition requires the Applicant <br /> to donate the 3 .9 acre portion of the site to the School <br /> District, if the School District takes action to accept the <br /> property within six months of the date of execution of these <br /> Findings and Conclusions. Based upon comments by the <br /> Mukilteo School District, City Council finds that this <br /> condition is adequate mitigation of the significant impacts to <br /> the School District generated by the Merrill Creek proposal . <br /> FINDINGS <br /> Recreation Facilities: The Parks Department generally <br /> requires apartment proposals to mitigate recreational impacts <br /> through SEPA by the provision of on-site facilities. The <br /> Applicant has proposed on-site recreational facilities to <br /> mitigate the impacts of the proposal on the community. A <br /> recreation center would be provided for each of the three <br /> multiple family phases. Both active and passive facilities <br /> are provided in each phase, with more facilities for children <br /> provided where the unit mix includes more two- and <br /> three-bedroom units and townhouses. Additional facilities <br /> which would be provided for all of the phases include a <br /> recreational exercise trail or Parcourse, active and passive <br /> recreation areas near each unit cluster to allow a range of <br /> free play such as frisbee, picnic tables and barbecue areas, <br /> and nature trails. <br /> The concomitant agreement includes conditions which <br /> require that open space areas and recreation facilities be <br /> 17 <br />
