access to the public roadway. The public roadway must be <br /> constructed to City Standards, including curbs, gutters, and <br /> sidewalks. The Concomitant Agreement includes conditions that <br /> eliminate parking from backing into the public right-of-way. <br /> In addition to the sidewalks on the public street, an <br /> on-site pedestrian circulation system would be provided <br /> throughout the site. The concomitant agreement requires that <br /> a concrete sidewalk system a minimum of 4 feet wide be <br /> provided. This system would provide a continuous walkway from <br /> each building to Merrill Creek Parkway and provide walkways <br /> between the phases where common access and facilities are <br /> provided. <br /> A recreational trail system would also be provided <br /> throughout the site. The concomitant agreement requires that <br /> this trail system consist of a minimum 4 foot wide pathway <br /> surfaced with 1/4 inch minus gravel . <br /> In addition, the concomitant agreement requires that all <br /> Uniform Fire Code Standards regarding fire lanes and access <br /> must be complied with. <br /> CONCLUSIONS <br /> The conditions in the concomitant agreement which require <br /> a public roadway to Phase 4 - the Single Family Plat, the <br /> sidewalk and trail systems, and compliance with Uniform Fire <br /> Code standards for access are adequate to provide safe <br /> vehicular and pedestrian circulation on the site. <br /> FINDINGS <br /> Access to Dilgard/Zevenbergen Properties: The City <br /> Subdivision Ordinance requires that proposed streets be <br /> extended to the boundary lines of the proposed tract to be <br /> short subdivided, unless prevented by topography or other <br /> physical conditions, and in the opinion of the City such <br /> extension is not necessary or desirable for the coordination <br /> of the layout of the subdivision with the existing layout or <br /> 24 <br />
