The use serves the public convenience and necessity. <br /> DECISION <br /> Based upon the preceding findings of facts and conclusions, the testimony and <br /> evidence submitted at the public hearing and upon the impressions of the <br /> Everett Hearing Examiner of the site view, it is hereby ordered that the <br /> requested Special Property Use Permit for a day care center located at 6533 <br /> Beverly Lane, Everett, Washington, is granted subject to the following <br /> conditions: <br /> 1. The day care facility shall be limited to a maximum of 12 children in <br /> accordance with a DSHS Mini Day Care Program License. <br /> 2. The Applicant shall inform parents that there is to be no unnecessary <br /> noise related to the drop off and pick up of the children. <br /> 3. The parents must use the on-street marked parking spaces on the east <br /> side of Beverly Lane between Tamarack and Beech for drop off and pick up <br /> of children. <br /> 4. Employees must use on-site parking. <br /> 5. All outdoor play activity shall be limited to the hours of 9:00 a.m. to <br /> 5:00 p.m. <br /> 6. Fire and Building Code requirements must be met. These code <br /> requirements are fully described in the Information to Developers in the <br /> Determination of Non-Significance (DNS). <br /> 7. The primary use of the dwelling must serve as a residence for a primary <br /> day care provider. <br /> 8. A six foot high solid wood fence shall be located and maintained between <br /> play areas and adjacent residential properties. The fence shall be <br /> located beyond the front setback and shall meet zoning code requirements. <br /> 9. Active play equipment and activities shall be located to minimize noise <br /> impacts on neighbors. For example: move play equipment (swing set) to <br /> the south of the garage. <br /> 10. The Applicant must comply with all mitigation measures listed in the <br /> Determination of Non-Significance (Exhibit 9). <br /> 11. All parents who use the facility must refrain from honking the horns of <br /> their vehicles when leaving the site. <br /> 7 <br />
