Tonia Maus - The witness submitted that she has used the day care <br /> facility for two and one-half years and she parks in the <br /> driveway. She contended that there is a resident on-site, Teresa <br /> Nelson, who is one of the Applicants. She stated that she does <br /> not want to unload her children on Beverly Lane because of the <br /> busy traffic. She supported the requested Special Property Use <br /> Permit. <br /> C. Jackie Schindler - The witness submitted that she is a client of <br /> the Applicants and uses the driveway to drop off her children. <br /> She claimed that the facility and the yard are clean. She stated <br /> that if it were not clean and maintained properly, she would not <br /> keep her children at the facility. <br /> D. Gloria Shapley - The witness submitted that she is the owner of <br /> property east of the subject property. She contended that the <br /> facility is detrimental to the enjoyment of her property. She <br /> stated that the day care facility begins at approximately 6:00 <br /> a.m. and noise is generated from the facility by cars. She <br /> further submitted that the facility is not kept in clean and good <br /> condition. She contended that a shack in the rear end of the <br /> property is not suitable for a nearyby play area for the <br /> children. <br /> CONCLUSIONS <br /> 1. The application is for the approval of a Special Property Use Permit for <br /> an expanded operation of a child day care center on property located at <br /> 6533 Beverly Lane, Everett, Washington. <br /> 2. The Everett Hearing Examiner has jurisdictional authority to hold a <br /> hearing and to issue a decision based on the authority granted him in <br /> Ordinance 1121-85, as amended. <br /> 3. A Special Property Use Permit is required for the facility pursuant to <br /> the provisions of EMC 19.58.010.C.2. <br /> 4. With conditions, the Special Property Use Permit satisfies the criteria <br /> for review as set forth in EMC 19.58.010.B(1-3). <br /> 5. The proposed use will be compatible with other uses and potential uses <br /> in the area in which it is located. The facility has been operated for <br /> two and one-half years and appears to be compatible with surrounding <br /> uses. The facility is similar in appearance to a single family <br /> residence and does not generate excessive traffic, noise or other <br /> disruptions of use to other properties. <br /> 7 -, <br />
