Driscoll, Hearing Examiner <br /> City Hall <br /> 3002 Wetmore Avenue <br /> Everett, WA. 98201 <br /> Subject: Mumm Day Care Center, SPU 6-89 <br /> Dear Mr. Driscoll, <br /> I'm writing in the matter of the Special Property Use Permit <br /> application filed by Patricia and David Mumm and Teresa Nelson for <br /> their property located at 6533 Beverly Lane, Everett Washington. This <br /> is a follow-up to my letter dated October 17, 1989 which was made <br /> part of the official record in the Findings and Decision of the Hearing <br /> Examiner of the City of Everett dated November 2, 1989. <br /> While your ruling of November 2, 1989 concludes the site may be used <br /> as an expanded child day care center, one of the conditions set for <br /> this approval is an error of fact, or at the very minimum, a <br /> contradiction to your stated findings and conclusions. <br /> I'm referring to item number 3, listed under the heading "Decision". <br /> This statement reads "The parents must use the on-street marked <br /> parking spaces on the east side of Beverly Lane between Tamarack and <br /> Beech for drop off and pick up of children". I find no substantive <br /> support for this condition listed in the "Findings of Facts" or <br /> "Conclusions". <br /> For example, item 15 under the Facts section indicates "The use will <br /> not have a serious adverse effect on the ecology and/or environment of <br /> the community". I support this finding and see no justification to <br /> restrict usage of the driveway if in fact your review of the situation has <br /> concluded there are no adverse effects as a result of day care <br /> operation. <br /> Item 16 concludes that "there is a public need for adequate and good <br /> child care services [in Snohomish County)". In today's world the <br /> definition of "adequate and good" used by most concerned parents and <br /> officials would certainly include the terms "healthy and safe". By <br /> forcing parents to load and unload infants, toddlers and children on <br /> the side of Beverly Lane violates the common sense I hope is used as a <br />
