. 1
component of your offices' decision. This street, Beverly Lane, is quite
busy as evidenced by the presence of multiple stoplights and bus stops.
It would also force parents to carry their children along the sidewalk
and up the lengthy driveway in inclement weather, exposing them to
wind and rain and increasing the possibilities of resultant illness.
Item 19. Mr. Drew Nielsen, in his statement for the opponent to the
Special Property Use Permit, indicated "that traffic on the driveway
creates problems for his clients in the early morning hours." 'These
"problems" were not detailed and I can only assume he is referring to
the sound created by car engines and doors. I find it
incomprehensible that this statement would lead to a decision to
disallow all cars from using the driveway at any time with the
exception of the employees. To begin with, you've already stated that
the use of this address for a child day care would not have a serious
adverse effect on the community (item 15). At the outside I could see
some kind of restriction of driveway use prior to 7:00 am but I see no
reason for later morning and evening use restrictions.
Furthermore, and most contradictory, your conclusion Number 5
(page 6), states "The facility is similar in appearance to a single family
residence and does not generate excessive traffic, noise or other
disruptions of use to other properties." Why then, if this is your
conclusion, would you set down a condition that parents can not use
the driveway?
In summary Mr. Driscoll, I appeal for reconsideration of your
Condition Number 3, as indicated above, on the basis of your own
offices' findings and conclusions as well as the broader scope of doing
what's in the best interests of our children's health and safety.
Sincerely,
Steven W. Weissenfluh
9522 62nd Dr. N.E.
Marysville, WA. 98270
