Use; and <br /> WHEREAS, the Planning Commission has recommended to the <br /> City Council that the requests of the applicant be denied, <br /> based upon Findings which the Planning Commission adopted in <br /> its Resolution No. 89-21; and <br /> WHEREAS, the City Council has reviewed and considered <br /> the recommendation of the Planning Commission at its own <br /> 1 public hearing and has considered the testimony of the <br /> applicant and the public. <br /> NOW, THEREFORE, BE IT RESOLVED, that the Applicant's <br /> request for Amendment to the Land Use Map of the Everett <br /> General Plan is hereby denied and, furthermore, the denial <br /> of the requested General Plan Amendment precludes City <br /> Council consideration of the Rezone request. <br /> The City Council bases this decision on the following <br /> findings: <br /> 1 . The Applicant has failed to demonstrate that <br /> circumstances have changed substantially since the adoption <br /> of the General Plan Land Use Map and Policies (Residential , <br /> 1986; Commercial, 1987) that warrant the changing of the <br /> subject residential property for commercial uses. <br /> 2. Through the lack of a specific site development plan <br /> for the proposed use of the subject property, the applicant <br /> has failed to demonstrate that the proposed amendment of the <br /> Everett General Plan and Rezone will result in a more <br /> efficient use of and improvement to the existing <br /> commercially zoned properties in the vicinity. <br /> 3 . The use of a local street (Fleming Street) as a land <br /> use transition between "Highway Commercial" and "Single <br /> Family Detached" uses is not sufficient to protect the <br /> character of the residential neighborhood located on the <br /> west side of Fleming Street. <br /> 4. The "Single Family Attached, 8 to 12 dwellings per <br /> gross acre" land use designation applied to the <br /> residentially zoned properties located on the east side of <br /> Fleming Street by the Land Use Map adopted in 1986 is <br /> intended to provide an appropriate land use transition <br /> between the more intensive "Highway Commercial" orientation <br /> of the properties fronting upon Evergreen Way, and the less <br /> intensive "Single Family Detached" neighborhood located on <br /> the west side of Fleming Street. <br /> 5. During the update of the General Plan Land Use Map in <br /> 1987, the Planning Commission considered areas where the <br /> "highway commercial" land use designation could be expanded <br /> to create a greater depth along Evergreen Way, but <br /> determined that additional commercial expansion should not <br /> encroach into residential neighborhoods. <br /> 6. Previous actions which have allowed an encroachment of <br />
