EXHIBIT A A. Operating Hours. Canteen shall operate its concession facility and use it to transact business with the public daily during hours approved by the City's designated agent. Hours shall be posted on the concession stand premises building so as to be easily viewed by the public at all times. Failure to open during scheduled hours or to keep scheduled hours will result termination of this Agreement. The City may direct Canteen to suspend operations temporarily for up to several days, when and as needed by the City. B. Staffing 1. All facilities and services must be sufficiently staffed with experienced or adequately trained personnel so as to prevent undue delay to customers. In determining what constitutes undue delay, consideration shall be given to the kinds and types of service being rendered and situations or conditions beyond the control of Canteen, such as unanticipated influxes of visitors, facility or equipment breakdowns, or sudden weather changes. The reasonableness of the delay, based on the above, will be the determining factor. 2. Canteen will complete a background check and a Washington State Patrol check for each employee used by Canteen to perform the Agreement. The background check will be conducted in compliance with all federal, state, and municipal laws, including in compliance with the EEOC Guidelines on making eligibility determination. Canteen will review all background check results on a case-by-case basis to ensure the safety and welfare of the City, customers, and all others who are serviced at the account. Canteen's determination regarding who is ineligible for work at the City's account will be job related and consistent with business necessity. Recognizing what is consistent with business necessity at the City's account based on the services Canteen is requested to perform, Canteen will closely examine all convictions and arrests for, among other offenses, crimes against vulnerable persons, such as children, the elderly or the disabled; crimes of dishonesty; crimes using or threatening violence including but not limited to, the use, display or threat of a weapon. 3. An active training program for the development of the necessary skills and techniques to operate a concession must be provided for all Canteen employees. These sessions shall stress work performance and also include product and service presentation, cleanliness, employee attitude and the Parks and Recreation Department philosophy and policy. Performance should be indicative of good training. C. Concession Facilities. Canteen shall be solely responsible for protecting the concession facilities against loss or destruction due to all perils, including but not limited to, theft, vandalism and fire. All maintenance and service performed on City owned structures and stalls shall be performed by employees of the City of Everett only, except for routine cleaning. Canteen shall not permanently alter or physically change any part of the premises that it is allowed to operate under this Agreement. Alterations and changes page 7
