EXHIBIT A <br /> A. Operating Hours. Canteen shall operate its concession facility and use it to <br /> transact business with the public daily during hours approved by the City's designated <br /> agent. Hours shall be posted on the concession stand premises building so as to be easily <br /> viewed by the public at all times. Failure to open during scheduled hours or to keep <br /> scheduled hours will result termination of this Agreement. The City may direct Canteen <br /> to suspend operations temporarily for up to several days, when and as needed by the City. <br /> B. Staffing <br /> 1. All facilities and services must be sufficiently staffed with experienced or <br /> adequately trained personnel so as to prevent undue delay to customers. In determining <br /> what constitutes undue delay, consideration shall be given to the kinds and types of <br /> service being rendered and situations or conditions beyond the control of Canteen, such <br /> as unanticipated influxes of visitors, facility or equipment breakdowns, or sudden <br /> weather changes. The reasonableness of the delay, based on the above, will be the <br /> determining factor. <br /> 2. Canteen will complete a background check and a Washington State Patrol <br /> check for each employee used by Canteen to perform the Agreement. The background <br /> check will be conducted in compliance with all federal, state, and municipal laws, <br /> including in compliance with the EEOC Guidelines on making eligibility determination. <br /> Canteen will review all background check results on a case-by-case basis to ensure the <br /> safety and welfare of the City, customers, and all others who are serviced at the account. <br /> Canteen's determination regarding who is ineligible for work at the City's account will <br /> be job related and consistent with business necessity. Recognizing what is consistent <br /> with business necessity at the City's account based on the services Canteen is requested <br /> to perform, Canteen will closely examine all convictions and arrests for, among other <br /> offenses, crimes against vulnerable persons, such as children, the elderly or the disabled; <br /> crimes of dishonesty; crimes using or threatening violence including but not limited to, <br /> the use, display or threat of a weapon. <br /> 3. An active training program for the development of the necessary skills and <br /> techniques to operate a concession must be provided for all Canteen employees. These <br /> sessions shall stress work performance and also include product and service presentation, <br /> cleanliness, employee attitude and the Parks and Recreation Department philosophy and <br /> policy. Performance should be indicative of good training. <br /> C. Concession Facilities. Canteen shall be solely responsible for protecting the <br /> concession facilities against loss or destruction due to all perils, including but not limited <br /> to, theft, vandalism and fire. All maintenance and service performed on City owned <br /> structures and stalls shall be performed by employees of the City of Everett only, except <br /> for routine cleaning. Canteen shall not permanently alter or physically change any part of <br /> the premises that it is allowed to operate under this Agreement. Alterations and changes <br /> page 7 <br />
