Dally Homes is willing to undertake certain additional review <br /> of the project and supply the results of that review to the City <br /> of Everett; <br /> NOW, THEREFORE, in consideration of the mutual promises and <br /> undertakings set forth herein, the parties agree as follows : <br /> 1 . Dally Homes agrees to retain the services of primary <br /> consultant Larry D. Burnstead and Jon W. Koloski and their <br /> respective firms , Watershed Dynamics and GEO Engineers , Inc . , to <br /> undertake the project analysis which is described in Exhibit "A" <br /> which is attached hereto and incorporated herein by this <br /> reference . Dally Homes agrees to pay the costs of the project <br /> analysis described in Exhibit "A. " <br /> 2 . Upon completion of the project analysis which is <br /> described in Exhibit "A, " Dally Homes shall make the same <br /> available to the City of Everett and its Responsible Official as <br /> well as the Appellants by and through its attorney, Douglas Marsh <br /> and Elmer Johnston. <br /> 3 . The Appellants , to the extent they desire to comment on <br /> the project analysis , shall provide their comment to the City of <br /> Everett ' s responsible official no later than seven ( 7 ) working <br /> days from the date they receive the draft report of the <br /> consultant ' s project analysis . It is understood that Appellants <br /> prefer that a two season wetland study be conducted. Appellants ' <br /> agreement hereunder shall not be construed to be a waiver of the <br /> right to take issue with the adequacy of the study undertaken. <br /> - 2 - <br /> BNC3301 <br />
