4 . The City of Everett, upon receipt of the project <br /> analysis , will use reasonable efforts to review the same as <br /> additional information voluntarily supplied by Dally Homes and <br /> make any determinations applicable thereto under the SEPA <br /> guidelines, ordinances and statutes within fourteen ( 14 ) days <br /> from the date delivered by Dally Homes . <br /> 5 . The Appellants agree to the affirmation of the <br /> Responsible Official 's Determination of Non-Significance (DNS) . <br /> By agreeing to this affirmation of the DNS, the Appellants are <br /> not waiving their rights to argue to the responsible official <br /> that the project analysis described herein has generated <br /> significant new information on the proposal ' s probable <br /> significant adverse environmental impacts , and therefore he/she <br /> should have taken one or more of the actions outlined in WAC 197- <br /> 11-340, or that the City has erred in making a determination of <br /> non-significance. Provided, however, the environmental review <br /> appeals , at the City of Everett level , will be deemed to have <br /> been exhausted and any further appeal of the environmental <br /> determinations shall be at the Superior Court level , after the <br /> City of Everett Hearing Examiner makes his decision on the <br /> preliminary plat application. <br /> 6 . Dally Homes agrees that Appellants can augment or <br /> address the existing traffic study data for the purposes of <br /> proposing alternative mitigation. Dally Homes agrees to <br /> participate in further discussions with the Appellants and the <br /> City to see if alternate mitigation measures may be <br /> - 3 - <br /> BNC3301 <br />
