appropriate . The additional traffic information and/or <br /> evaluation shall be provided by Appellant to the City and Dally <br /> within twenty-one ( 21) days from the date of this agreement . The <br /> City shall convene the meeting( s ) to discuss mitigation <br /> alternatives , if any, within seven ( 7 ) days thereafter. If <br /> alternative mitigation measures are deemed appropriate by the <br /> City, it shall issue an addendum to the DNS which set forth the <br /> alternate mitigation measures . <br /> 7 . Dally Homes agrees that, in the event it sells , assigns <br /> or otherwise transfers its interest in the determination of non- <br /> significance issued for the project and the subject matter of the <br /> appeal, the terms of this agreement shall be binding upon any <br /> successor or assign of Dally Homes who proceeds with the <br /> development of the project under the issued determination of non- <br /> significance and without further environmental review; provided, <br /> however, the terms of this agreement shall not be binding upon <br /> any party or entity which files new development applications and <br /> requests new or additional environmental review for development <br /> of the property. In the event Dally Homes does not construct the <br /> project which is the subject matter of the proposal for which the <br /> determination of non-significance issued, and does not convey its <br /> interest in the DNS for the project to a third party, this <br /> agreement shall automatically terminate, expire and be of no <br /> further force or effect . <br /> 8 .
