000005, <br /> IN THE MATTER OF THE APPLICATION OF <br /> BAY RIDGE DEVELOPMENT FOR APPROVAL OF <br /> A SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT • SMA 7-88 <br /> ORDER REGARDING MOTIONS FOR RECONSIDERATION <br /> On April 18, 1989, the Hearing Examiner of the City of Everett issued approval <br /> of a Shoreline Substantial Development Permit for the above captioned <br /> application. Pursuant to the Rules of Procedure of the Everett Hearing <br /> Examiner, the following submitted requests for reconsideration: <br /> 1. Brad Cattle <br /> 2. Silver Lake Action Committee <br /> 3. Jeanine Oudeans <br /> 4. Dorthy Vandeventer <br /> 5. David Bartle <br /> 6. Alexander Kaminski <br /> 7. Everett School District <br /> Because of the complexity of the Motions for Reconsideration, the hearing was <br /> reconvened in order to supplement the record on issues regarding the school <br /> bus stop on the internal road of the proposed development (Condition #25) and <br /> the computation of acreage and density in the proposed project. The hearing <br /> was reconvened on May 18, 1989. At the hearing the following presented <br /> testimony and evidence: <br /> 1. Brad Cattle <br /> 2. Tony Shapiro <br /> 3. Dorthy Vandeventer <br /> 4. Chuck Patten <br /> 5. Gerry Ervine <br /> At the hearing the following exhibits were submitted and were admitted as part <br /> of the official record of this entire proceeding: <br /> 28. Letter dated 5-17-89 from Dodds Engineers Inc. to Bay Ridge <br /> 29. Letter dated 5-15-89 from Peggy Claflin <br /> 30. Submittal dated 5-18-89 from Dorthy Vandeventer <br /> 31. Submittal dated 5-18-89 from Brad Cattle Regarding Density <br /> Based upon a review of the record and the findings and conclusions supporting <br /> the decision issued on April 18, 1989, the following additional findings of <br /> facts and conclusions are submitted. After a statement of the findings of <br /> facts and conclusions, the issues raised by each of the named petitioners for <br /> reconsideration will be addressed. <br /> 000037 <br />
