Z/477 1 2 A RESOLUTION establishing the compensation for street vacations, exceptions thereto, providing a method of appraising 3 streets to be vacated and establishing criteria for partial vacations and repealing Resolution No. 1724. 4 5 WHEREAS, the City Council is authorized to vacate streets and alleys; 6 and 7 WHEREAS, RCW 35.79.030 allows a city when vacating a street, alley or 8 portion thereof to require compensation from abutting property owners which 9 does not exceed one-half of the appraised value of such vacated area. 10 However, in the event the street, alley or portion thereof vacated was 11 acquired at public expense, compensation may be required in an amount equal 12 to the full appraised value of the vacated right-of-way; and 13 WHEREAS, the City Council desires to establish a uniform policy for the 14 payment of compensation for street and alley vacations, to provide a method 15 16 of appraising such streets and alleys to be vacated and establish criteria 17 concerning partial vacations; 18 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT: 19 20 Section 1 : Ordinances vacating any street, alley or any portion 21 thereof pursuant to the provisions of Chapter 35.79 RCW shall provide that 22 the ordinance shall not become effective until the owners of property 23 abutting upon the street, alley or any portion thereof so vacated, shall pay 24 to the City one-half the appraised value of the area so vacated. However, 25 in the event the street, alley or portion thereof was acquired at public 26 expense, then the compensation provided shall be the full appraised value of 27 the area so vacated. 28 Section 2: The amount of compensation determined in Section 1 may be 29 modified if any of the following apply: 30 A.
