1 property is at a location and in an alignment acceptable to the City Council <br /> 2 and the City Council is desirous of accepting such parcel , then either in <br /> 3 lieu of compensation determined owing in Section 1 or as partial <br /> 4 compensation the parcel may be deeded to the City subject to Section 3 of <br /> 5 this resolution; and <br /> 6 B. When the City of Everett is the owner of property abutting upon <br /> 7 the street, alley or portion thereof to be vacated and the City Council <br /> 8 chooses to waive the City' s required contribution and/or fees, then the <br /> 9 total amount of compensation determined owing in Section 1 may be reduced by <br /> 10 the amount the City Council chooses to waive. <br /> 11 Section 3: The petitioner(s) shall be required to pay the application <br /> 12 fee, the appraisal fee and, depending upon whether the street or alley was <br /> 13 acquired at private or public expense, one-half or the entire appraised <br /> 14 value in the case of a vacation where there is no property "exchanged" in <br /> 15 lieu of compensation as provided in Section 2(A) . In the case that the <br /> 16 property to be provided the City in lieu of compensation contains less area <br /> 17 than the property proposed to be vacated, the petitioner(s) shall pay the <br /> 18 appraisal costs, the application fee and, depending upon whether the street <br /> 10 or alley was acquired at private or public expense, either one-half or the <br /> 20 entire appraised value of the difference in value of the two parcels. <br /> 21 Section 4: In all instances requiring an appraisal to be made to <br /> 22 establish the appraised value of the street, alley or portion thereof to be <br /> 23 vacated, the appraisal shall be made with regard to the "value" the street <br /> 24 or alley vacated would add (contribute) to the abutting properties. <br /> 25 Section 5: As a general rule the City of Everett will not accept nor <br /> 26 process applications for partial street or alley vacations; provided, <br /> 27 however, on a case by case basis the City may accept and process an <br /> 28 application for partial vacation when in the opinion of the City's Public <br /> 29 Works Director or his designee the proposed partial vacation meets the <br /> 30 requirements for regular vacations and also meets the following criteria: <br /> 31 a. the partial vacation is in the best interests of the City <br /> and is not for the primary purpose of serving the interests <br /> 32 of a limited number of property owners; <br /> 2 <br />
