'"00011 <br /> 5. Criteria: The public interest suffers no substantial <br /> detrimental effect. <br /> Response: The public will benefit from this proposal through <br /> the education provided to the public by this project and <br /> increased scientific knowledge provided by this project. No <br /> substantial detrimental effects are anticipated. <br /> NOW, THEREFORE, BE IT RECOMMENDED BY THE PLANNING COMMISSION TO THE EVERETT <br /> CITY COUNCIL that the Shoreline Substantial Development Conditional Use <br /> Permit for the Port of Everett to allow the deposition of approximately <br /> 300,000 cubic yards of hydraulically dredged sand to construct a berm on the <br /> west side of Jetty Island Be Granted with the following conditions: <br /> 1. That the Port work in conjunction with the Everett Parka and <br /> Recreation Department for the provision of interpretive signs on <br /> Jetty Island in accordance with existing Everett Parks interpretive <br /> sign standards. <br /> 2. Vegetation plan dealinj with the berm and salt marsh area shall be <br /> submitted to the Planning Department prior to commencement of any <br /> disposal activities. <br /> 3. A Hydraulic Project Approval must be obtained from the Washington <br /> State Department of fisheries prior to placement of any fill below <br /> the ordinary high water mark on Jetty Island. <br /> 4. A Water Quality Certification shall be obtained from the Washington <br /> State Department of Ecology prior to placement of any fill on the <br /> subject property. <br /> 5. Notice shall be given to the Everett Planning Department at least two <br /> weeks prior to the commencement of any dredging and disposal activity. <br /> 6. Detailed dredged material disposal plans and instruction to the <br /> contractor shall be submitted to the Planning Department prior to <br /> commencement of any disposal activity. <br /> 7. Construction or substantial progress toward construction of a project <br /> must be undertaken within 2 years after final approval of the permit, <br /> and completed within 5 years.
