1 RESOLUTION NO r2)Z2 <br /> 2 <br /> 3 A RESOLUTION adopting findings, conclusions and decision <br /> regarding appeal of SEPA Determination No. 61 -88, Bay Ridge <br /> 4 Development. <br /> 5 WHEREAS, City Council finds that having considered the appeal of SEPA <br /> 6 <br /> Determination No. 61 -88, Bay Ridge Development, it is required in accordance <br /> 7 <br /> with Section V11C of Ordinance No. 1348-87 to issue a written determination <br /> 8 <br /> containing findings of facts and conclusions of law; <br /> 9 <br /> 10 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> 11 EVERETT THAT: <br /> 12 <br /> Section 1 : Finding. <br /> 13 <br /> The Responsible Official issued a Determination of Non-Significance, <br /> 14 <br /> SEPA No. 61 -88, for a One Hundred and Eighty-eight (188) unit apartment <br /> 15 <br /> complex known as Bay Ridge Development on June 27, 1988. An appeal was <br /> 16 <br /> filed by Tom Lux on July 11 , 1988, and a public hearing was held before the <br /> 17 <br /> City Council on August 17, 1988. A public meeting was held before Council <br /> 18 <br /> concerning the same matter on September 21 , 1988. <br /> 19 <br /> Conclusion. In accordance with Section V11C of Ordinance No. <br /> 20 <br /> 1348-87 the City Council has jurisdiction to hear the appeal of <br /> 21 <br /> Determination of Non-Significance No. 61 -88. An appeal by an aggrieved <br /> 22 <br /> party was timely filed and a hearing and a public meeting were held before <br /> 23 <br /> the City Council in a timely manner. <br /> 24 <br /> Section 2: Finding. <br /> 25 <br /> City Council held a public hearing at which time testimony was taken <br /> 26 <br /> from City staff, Applicant, Appellant and members of the general public on <br /> 27 <br /> August 17, 1988. Following the public hearing, City Council remanded the <br /> 28 <br /> matter to staff for the purpose of acquiring additional information <br /> 29 <br /> concerning the following issues: wetlands, traffic, tree <br /> 30 <br /> inventory/landscaping, drainage plan, tot lot, St. Peter's house, Lake fill , <br /> 31 <br /> access to Monroe School , impervious surface area and site plan.
