21. Ross Avenue within Riverfront Park will be vacated at the time . City acquires the park site from DNR. The Public Works Depart will coordinate the vacation of Ross Avenue and the Parks Departs._ _ will provide a gate system to control access. 22. Special charges for connection to sewer system in accordance with Ordinance 984-83 are applicable. The actual cost shall be computed by the Building Division per the ordinance in effect at the time and according to the information provided on the approved plans on the date of permit issuance. 23. Interim water and sewer service for this site will be provided to adequately service this site. The City will participate in future Smith Island water and sewer L.I.D. 24. The dredge spoils lease on the southern portion of the subject property will be extended to 1992 if all necessary permits are obtained including a Shoreline Permit and on condition that the City shall have the right to utilize the dredge materials for City purposes only. 25. Minor deviations (10% or less) from the proposed plans shall be reviewed by the Planning Director to determine if additional public review is necessary. Major deviation from the instant application shall be submitted for review and approval by the Planning Commission. 26. Construction or substantial progress toward construction of the project must be undertaken within two years after final approval of the permit and completed within five years. If the project has not been completed in this time span, the permit will be reviewed by the Planning Department which will either extend the permit for a period of one year or terminate the permit.
