Conclusion: If this is required as a mitigation measure for the <br /> Corps Permit, a separate shoreline permitmust be submitted, reviewed <br /> and approved. <br /> 7. Conditional Use Permit <br /> A. Finding: CONDITIONAL USE <br /> The RADCAD site is located in a Conservancy-Recreation shoreline <br /> environment which permits dredge spoils disposal as a conditional <br /> use. The purpose of a conditional use provision is to provide more <br /> control and flexibility in the implementation of the master program <br /> regulations along Everett's shoreline. With measures to control <br /> undesirable effects, the range of uses within each of the six <br /> environments can be expanded to include many uses. <br /> Uses classified as conditional uses can be permitted only after <br /> consideration by Planning Commission and City Council and by meeting <br /> performance standards and conditions that make the use compatible <br /> with other permitted uses within the environment. <br /> Conditional use permits will be granted along Everett's shoreline <br /> only after the Applicant can demonstrate all of the following: <br /> 1 . The proposed use will not be contrary to the general intent of <br /> Everett's Master Program. <br /> 2. The proposed use will not interfere with the normal public use <br /> of public shorelines. <br /> 3. The proposed use of the site and design of the project will be <br /> compatible with other permitted uses in the area. <br /> 4. The proposed use will cause no significant adverse effects to <br /> the shoreline environment in which it is to be located. <br /> 5. The public interest suffers no substantial detrimental effect. <br /> Conclusion: The use of the RADCAD disposal method in compliance with <br /> the conditions listed below will be consistent with the Everett <br /> Shoreline Master Program, will not interfere with the normal public <br /> use of the public shorelines, will be compatible with recreational <br /> activities in the area, will cause no significant adverse effects on <br /> the shoreline, and the public interest suffers no substantial <br /> detrimental effects. <br /> NOW, THEREFORE, THE PLANNING COMMISSION RECOMMENDS TO THE CITY <br /> COUNCIL THAT THE UNITED STATES NAVY CONDITIONAL USE SHORELINE SUBSTANTIAL <br /> DEVELOPMENT PERMIT for the removal of spoil materials from the East Waterway <br /> and the disposal of contaminated dredge spoils to be capped with clean <br /> dredge spoils in a confined in-water disposal site, BE APPROVED with the <br /> following conditions: <br /> Conditions <br /> The Planning Department recommends the approval of the U.S. Navy's <br /> Conditional Use - Shoreline Substantial Development Permit .with the <br /> following conditions: <br /> 1 . The Navy must comply with all conditions and requirements of the WDOE <br /> Water Quality Certification. The Conditions and requirements <br /> include, but are not limited to, the following: <br /> -19- <br />
