A. Organotin Bottom Paint: <br /> No Everett homeported ships using organotin bottom paint shall <br /> be allowed into the Everett Homeport until after the EPA study <br /> (FIFRA) of the issue is complete. If, after that, <br /> organotin-painted are homeported in Everett, organotin <br /> monitoring shall be conducted in a no-less-rigorous fashion <br /> than at other Navy ports proposed for monitoring. However, <br /> sediment analysis for organotin shall be included as a <br /> component of the monitoring. <br /> Baseline monitoring (including sediments), after dredging and <br /> before ships are introduced, shall be conducted. If, in the <br /> future, sediment or water quality criteria for organotin are <br /> established, the U.S. Navy as well as other potential sources <br /> will be required to meet the criteria. The Navy shall submit a <br /> proposed monitoring plan to the department six months prior to <br /> the first ship using organotin bottom paint is scheduled to <br /> arrive at the Everett facility. <br /> B. Fuel Oil Transfer and Storage: <br /> The tank farm must be diked and totally lined with impervious <br /> material. Drainage control must be designed such that drains <br /> are normally closed and a positive action is required to <br /> release rainwater to either a treatment system or storm drains <br /> as appropriate. All barge (or ship/shore) transfer of fuel <br /> shall occur on the East Waterway side of the base and none on <br /> the Snohomish River side. <br /> C. Graywater: <br /> All ships must comply with all federal and state requirements <br /> relating to the discharge of graywater. There shall be no <br /> discharge of graywater by Everett homeported ships. A brief <br /> phase-in period, while appropriate provisions are made to meet <br /> this latter condition will be allowed. Such a phase-in period <br /> shall not exceed two years from the introduction of the first <br /> Everett homeported ship. <br /> D. Timing: <br /> For Phase I, no dredging or disposal of contaminated dredge <br /> material shall take place between December 1 and July 15 and no <br /> dredging or disposal of clean material shall occur between <br /> January 15 and June 15. Pile driving or rock breakwater <br /> construction shall not occur from March 15 to June 15 unless <br /> otherwise modified by the Washington State Department of <br /> Fisheries. The Department of Ecology in consultation with the <br /> Department of Fisheries, where necessary, may grant a <br /> reasonable extension of time for the dredging and dumping of <br /> clean material. Modifications to state water quality standards <br /> that are to be issued will be limited to times of dredging or <br /> dredge disposal. <br /> For Phase II dredging, the period allowable for dredging and <br /> disposal will be adjusted by taking into consideration the data <br /> and information from Phase I dredging. Such information will <br /> include, but not be limited to, water quality and aquatic life <br /> date and information. <br /> E. The Navy shall comply with all conditions and requirements set <br /> forth in the Water Quality Certification Monitoring Program. <br /> F. All other conditions and requirements of the WDOE Water Quality <br /> Certification not specifically set forth herein must be <br /> complied with by the Navy. <br /> -20- <br />
