PLANNINC COMMISSION MINUTES <br /> February 17, 1987 <br /> The meeting was called to order at 6:42 p.m. by Chairperson Gretchen Shaffer. <br /> Also present were Chuck Moser, Dee Buchea, and Bill Wright. <br /> This hearing is to present a Shoreline Substantial Development Permit on Smith <br /> Island, west of Highway 99 North, fronting on Union Slough, within the E 1/2 of <br /> Sec. 5, T. 29 N. , R. 5 E.W.M. The application is Ruth E. Ruppert, owner of the <br /> Everett Development Company. <br /> The project is to allow the filling of approximately 66 acres with up to 800,000 <br /> cubic yards of clean inorganic fill material and the construction of industrial <br /> buildings totaling approximately 1,300,000 square feet in area. The fill <br /> material will be obtained from numerous sources with each source to be evaluated <br /> by DOE and EPA prior to initiating any filling. This review will identify <br /> physical, chemical, and biological character of landfill material; source of <br /> fill; method of placement and compaction; type of proposed surfacing; and method <br /> of perimeter erosion control. This information has not been generated to date <br /> as the source(s) of this large volume of material has not yet been identified. <br /> All building sites will be filled to two feet of freeboard above the 100-year <br /> flood elevation to comply with Commercial/Industrial Flood Fringe District <br /> zoning applied to this property and the Federal Flood Insurance Program. <br /> Gerry Ervine presented the staff report for the City stating the above facts and <br /> others and then proceeded to show slides. <br /> Gerry advised the Planning Commission that the City is planning to hire a <br /> consultant to update the Smith Island Substantial Shoreline Plan. The City is <br /> now using Snohomish County's Shoreline Master Plan to guide development on Smith <br /> and Spencer Islands. <br /> Gerry then reviewed a letter from the Department of Ecology received on <br /> February 17, 1987 reporting that a statement in the Determination of <br /> Non-Significance that fill material will be evaluated by the Department of <br /> Ecology is misleading since Ecology has no legal authority to review or evaluate <br /> fill material. Problem waste disposal will be controlled by the local health <br /> department. <br /> Chuck Moser wondered then who polices the fill. If it is contaminated, who <br /> brings it to the attention of the Health Department? To which Gerry Ervine <br /> answered that inspectors from Public Works will inspect the fill and inform the <br /> Health District if there appears to be a violation. <br /> There then followed a discussion on fill materials. Chuck asked further what is <br /> the responsibility of the Department of Ecology and Environmental Protection <br /> Agency in the fill issue. Gerry Ervine will get documentation from DOE, EPA and <br /> the Snohomish Health District as to their respective responsibilities in this <br /> area. <br />
