41. <br /> 1 RESOLUTION NO.o ��-3 <br /> 2 A RESOLUTION declaring an emergency to exist and authorizing the <br /> Building Official to secure and provide emergency repair for the <br /> 3 building located at 1507 Wall Street, the Monte Cristo Hotel <br /> Building. <br /> 4 <br /> 5 <br /> WHEREAS, the City Council finds that the building which is located at <br /> 6 <br /> 1507 Wall Street, the Monte Cristo Hotel Building, has been declared a dangerous <br /> 7 <br /> building pursuant to the Notice and Order of the City of Everett Building Official dated <br /> 8 <br /> July 2, 1986; and <br /> 9 <br /> WHEREAS, the City Council finds that proceeding under the Notice and Order <br /> 10 <br /> has been delayed for various reasons including a request to stay the abatement <br /> 11 <br /> proceedings for the purpose of facilitating restoration of the building; and <br /> 12 <br /> WHEREAS, the City Council finds that during the pendency of this proceeding, <br /> 13 <br /> the problems have not been remedied nor has the restoration process commenced; and <br /> 14 <br /> WHEREAS, the City Council finds that the building has continued to decay <br /> 15 <br /> resulting in extreme deterioration to the upper southwest and southeast areas of the <br /> 16 <br /> building, particularly the parapet walls which are on the verge of falling down, the <br /> 17 <br /> 18 southeast corner of the penthouse, and the chimney; and <br /> AO WHEREAS, the City Council finds that the present condition of these portions of <br /> 19 <br /> 20 the building create a significant problem in that it is a hazard to the health and safety <br /> 21 of the general public; and <br /> 22 WHEREAS, the City Council finds that the building is not properly secured; and <br /> 23 WHEREAS, the City Council finds that it is imperative that immediate action be <br /> 24 taken at this time; and <br /> 25 WHEREAS, the City Council finds that the City has barricaded the sidewalk in <br /> 26 the immediate vicinity of the building and has closed the bus shelters at that location; <br /> 27 and <br /> 28 WHEREAS, the City Council finds that these measures taken (barricading, <br /> 29 closing of shelters) are insufficient to deal with the significant safety problems created <br /> 30 by the current condition of those portions of the building described herein; and <br /> 31 WHEREAS, the City Council finds that the normal abatement proceedings would <br /> 32 take too long to implement; and <br />
