General Regulation of Use Activities <br /> Effective management of Everett' s limited shoreline resource <br /> requires reasonable regulation of the various activities within <br /> the specific environments. The following regulations shall <br /> apply to all activities permitted along Everett' s shoreline. <br /> These regulations are aimed at safeguarding the interest of <br /> Everett' s citizens in the area of air and water quality, public <br /> access (visual and physical) to the shoreline, and aethestic <br /> impact. <br /> General Regulations : <br /> The following regulations shall apply to all permitted uses in <br /> any environment along Everett ' s shoreline: <br /> 1. Activities permitted along Everett's shoreline shall conduct <br /> their operations in accordance with existing regulations <br /> regarding air and water quality. <br /> 2. All activities shall provide a means of reducing the <br /> polluting potential of surface water runoff, generated <br /> from impervious surfaces such as streets , parking lots <br /> and storage areas . Such devices may be those most <br /> practical and feasible. This requirement is not meant <br /> to duplicate any requirements that might be stated by <br /> the Department of Ecology as part of the NPDES Program. <br /> 3. Activities involved in the handling and storage of fuel, <br /> chemicals , oil and other substances with the potential <br /> for spillage into adjacent waters , shall have operational <br /> procedures to handle potential spills. In addition <br /> physical structures which would contain any potential <br /> spills shall also be provided. Procedures meeting <br /> state or federal requirements shall be acceptable. <br /> 4. The placement and design of structures on shoreline sites <br /> shall be done in a manner which is least detrimental to <br /> shoreline views and vistas. In certain instances this <br /> may be accomplished by orienting the length axis of the <br /> building and/or operation parallel to the view line. <br /> 5. Any building or structure within 200 feet of the ordinary <br /> high water mark, in excess of 35 feet in height shall <br /> provide data showing that it will not obstruct the view <br /> of a substantial number of residences on the areas <br /> adjoining such shorelines. This regulation does not <br /> apply to cranes , utility poles or other devices required <br /> to carry on water-dependent operations. ( The intent of <br /> -4-- this regulation is not to reduce the height limitation <br /> presently allowed in any multi-family zone. ) <br /> TV-6 Exhibit 5 <br /> Master Program <br />
