12. That prior to filling the subject property, the applicant shall provide through the State Environmental Policy Act (SEPA) Threshold Determination Process, the following specific information: a. Physical, chemical and biological character of landfill material; b. Source of landfill material; (The fill material shall be obtained from either the upper or lower settling basins or the navigation channel of the Snohomish River and other approved upland sources.) . c. Method of placement and compaction; d. Type of proposed surfacing; e. Method of perimeter erosion control; f. Proposed use of filled area. This information will be provided to the City of Everett Planning Commission, all agencies with jurisdiction, agencies with expertise, j and to all environmental groups expressing an interest in this application. No fill permits will be issued until all SEPA review requirements have been satisfied. 13. Grass plantings or other appropriate measures as approved by the City shall be used on the surface of all filled portions of the site to control dust after completion of the fill. 14. The applicant shall provide an easement to the City allowing access, maintenance and management of all wetland areas as shown on Exhibit #2. The applicant shall provide a survey and/or legal description of areas to be conveyed to the City. 15. Simpson or subsequent owners reserve the right to donate the wetlands at any time to the City of Everett Parks and Recreation Dept. 16. Simpson and/or its assigns agree not to request through permit application any actions which would reduce or eliminate the water interchange between the Snohomish River and the wetlands so long as such a request by Simpson or its assigns is not essential to protect the developed property. 17. That an access easement be provided to the City of Everett to Lift Station #17 from the existing railroad crossing at Junction Street (47th) or by another route acceptable to the City. Should Lift Station #17 be abandoned, the above described easement is extinguished. 18. Construction or substantial progress toward construction of a project must be undertaken within two years after final approval of the permit and completed within five years.
