12. That prior to filling the subject property, the applicant shall <br /> provide through the State Environmental Policy Act (SEPA) Threshold <br /> Determination Process, the following specific information: <br /> a. Physical, chemical and biological character of landfill <br /> material; <br /> b. Source of landfill material; (The fill material shall be <br /> obtained from either the upper or lower settling basins or the <br /> navigation channel of the Snohomish River and other approved <br /> upland sources.) <br /> . c. Method of placement and compaction; <br /> d. Type of proposed surfacing; <br /> e. Method of perimeter erosion control; <br /> f. Proposed use of filled area. <br /> This information will be provided to the City of Everett Planning <br /> Commission, all agencies with jurisdiction, agencies with expertise, <br /> j and to all environmental groups expressing an interest in this <br /> application. No fill permits will be issued until all SEPA review <br /> requirements have been satisfied. <br /> 13. Grass plantings or other appropriate measures as approved by the City <br /> shall be used on the surface of all filled portions of the site to <br /> control dust after completion of the fill. <br /> 14. The applicant shall provide an easement to the City allowing access, <br /> maintenance and management of all wetland areas as shown on Exhibit <br /> #2. The applicant shall provide a survey and/or legal description of <br /> areas to be conveyed to the City. <br /> 15. Simpson or subsequent owners reserve the right to donate the <br /> wetlands at any time to the City of Everett Parks and Recreation Dept. <br /> 16. Simpson and/or its assigns agree not to request through permit <br /> application any actions which would reduce or eliminate the water <br /> interchange between the Snohomish River and the wetlands so long as <br /> such a request by Simpson or its assigns is not essential to protect <br /> the developed property. <br /> 17. That an access easement be provided to the City of Everett to Lift <br /> Station #17 from the existing railroad crossing at Junction Street <br /> (47th) or by another route acceptable to the City. Should Lift <br /> Station #17 be abandoned, the above described easement is <br /> extinguished. <br /> 18. Construction or substantial progress toward construction of a project <br /> must be undertaken within two years after final approval of the <br /> permit and completed within five years.
