2. That the site be filled in accordance with the site )131i attached as <br /> Exhibit #2 retaining a 50-foot riparian zone adjacent to the <br /> Snohomish River. Any fill shall occur within the existing dike <br /> 1 system and any hydraulic fill must be designed to: a) prevent short <br /> circuiting of discharge water through proper location of inlet and <br /> outlet structures; b) have adequate discharge controls installed; and <br /> c) provide capacity and detention times for return water necessary to <br /> properly settle out fines. <br /> 3. That notice shall be provided to the Planning Department at least two <br /> weeks prior to placement of fill on the subject property. <br /> 4. An eighty foot right-of-way is to be dedicated to the City for <br /> ingress, egress and utilities resulting in a new north/south City <br /> arterial street upon issuance of a Shoreline Permit which would allow <br /> construction of structures on the subject property. This north/south <br /> corridor from 36th Street to the Simpson property in an alignment <br /> approved by the Public Works Department shall be used for all <br /> construction vehicle access with the exception that fill related <br /> workers may use the Junction Street access for their personal <br /> vehicles (limited to vehicles of one ton capacity or less) if <br /> approved by Burlington Northern Railroad. Upon completion of <br /> improvements on the subject property, only maintenance/emergency <br /> vehicle access will be permitted at this Junction Street crossing. <br /> 5. If the proposed fill is intended to support structures at a later <br /> date, the fill shall be placed in accordance with the Uniform <br /> Building Code. Should the applicant not wish to construct a fill <br /> intended to support a structure at a later date, he is required to <br /> submit a letter to the City so stating. The letter will be recorded <br /> against the property. <br /> 6. An easement must be granted to the City for a sewer main extension <br /> through the property. <br /> 7. That the Applicant obtain a Public Works Permit for filling and <br /> grading the subject property and that the Applicant provide a control <br /> gate secured with locks to control the type of fill material placed <br /> j on the property. Only clean inorganic fill material is permitted. <br /> 8. Any additional filling of the property beyond that shown on Exhibit <br /> #2 (approximately 200' setback from Snohomish River) may only be <br /> permitted upon presentation of detailed plans, and specifications and <br /> completion of a normal Shoreline Permit process, with proof to City <br /> Council's satisfaction that no significant adverse impact will result <br /> to Dike District No. l 's dike. <br /> 9. All dike and fill operation are to be conducted in accordance with <br /> existing regulations regarding air and water quality. <br /> 10. Water separating and treatment facilities for storm runoff shall be <br /> developed and maintained both during and after construction. Use of <br /> existing wetlands for such purposes is authorized subject to <br /> compliance with water quality controls. <br /> 11 . Maintenance on and/or replacement of the protective bank cribbing <br /> along the sharp bend of the Snohomish River shall be accomplished by <br /> Simpson Paper Company, Inc. during this phase of development. <br /> -4- <br />
