WHEREAS, the City Council finds that the Citizens Advisory Committee <br /> has studied the issue of adult use business zoning, has reviewed the <br /> findings made by other municipalities concerning the regulation of adult use <br /> business through zoning and has heard testimony concerning the operations of <br /> adult use businesses and the adverse secondary effects of these businesses <br /> from members of the general citizenry, the law enforcement community and <br /> from the adult use business industry; and <br /> WHEREAS the United States Supreme Court in the case of City of Renton <br /> v. Playtime Theaters Inc. determined that the City of Everett could rely on <br /> the experiences of other jurisdictions in establishing the justification for <br /> regulating adult use businesses through zoning; and <br /> WHEREAS, the City Council, in reviewing the Adult Use Committee <br /> Report to City Council, dated July 3, 1986, the record of the City of <br /> Everett Planning Commission, the experience of other communities, local <br /> experience, and public testimony taken before the Citizens Advisory <br /> Committee, Planning Commission and the Everett City Council adopts the <br /> following findings which it believes are true and reasonably applicable to <br /> the City of Everett's consideration and adoption of adult use business <br /> zoning regulations: <br /> 1. That the presence of adult use businesses increase the <br /> risk to the public health, safety, and welfare of the <br /> community. <br /> 2. That adult use businesses jeopardize the character and <br /> quality of residential life in the City and threaten <br /> children living in residential communities with offensive, <br /> dehumanizing and demoralizing influences. <br /> 3. That the City has a great interest in preserving the <br /> character and quality of its residential neighborhoods and <br /> urban life and in protecting its youth from offensive, <br /> dehumanizing and demoralizing influences. <br /> 4. That the image of the City as a pleasant and attractive <br /> place to reside will be adversely effected by the presence <br /> of adult use businesses in close proximity to residential <br /> land uses, churches, parks, playgrounds and schools due to <br /> the secondary effects of adult businesses. <br /> -2- <br />
