CITY <br /> INTERLOCAL AGREEMENT <br /> BETWEEN <br /> THE CITY OF EVERETT AND PUBLIC UTILITY DISTRICT NO. 1 OF SNOHOMISH <br /> COUNTY <br /> REGARDING JOINT ROADWORK PROJECT <br /> This Interlocal Agreement("Agreement") is dated for reference purposes <br /> Jtt v,-e,2, , 2017, and is between the CITY OF EVERETT (the"City") and the PUBLIC <br /> UTILITY DISTRICT NO. 1 OF SNOHOMISH COUNTY(the "District") (individually a <br /> "Party"and collectively the "Parties"). <br /> RECITALS <br /> A. The Parties have determined that certain work must be completed on the <br /> Diversion Dam Road. Some portions of this road are on City property and some are on District <br /> property. <br /> B. The Parties have determined it would be more efficient if the work were <br /> completed in a single project. This project is referred to in this Agreement as the "Joint <br /> Roadwork Project." Accordingly, the Parties have agreed that the City will complete the Joint <br /> Roadwork Project, with the District reimbursing the City for some of the project costs, all in <br /> accordance with this Agreement. <br /> AGREEMENT <br /> The Parties agree as follows: <br /> SECTION 1: JOINT ROADWORK PROJECT <br /> A. Plans and Specifications. <br /> 1. Completion of Plans and Specifications. The City will prepare (or will <br /> have its consultants prepare) all plans, specifications and cost breakdowns necessary to construct <br /> the Joint Roadwork Project. The District will have an opportunity to participate in design team <br /> meetings and will have a reasonable opportunity to review and comment. <br /> 2. District Approval. After receiving all District comments, the City will <br /> submit its proposed final plans, specifications and cost breakdown to the District for final review. <br /> The District must either approve or disapprove in writing the City's proposed final plans and <br /> specifications within 30 calendar days after they are delivered to the District (the "Project <br /> Review Period"). District approval will not be unreasonably withheld. If the District does not <br /> provide the approval or disapproval to the City within the Project Review Period, the plans and <br /> specifications are deemed approved. For the purposes of this Agreement, the term "Approved <br /> Plans and Specifications" refers to final plans and specifications that are approved under this <br /> Section 1.A.2. <br /> 1 <br />
