B. Permitting. <br /> 1. City to Obtain Permits. The City will apply for and obtain any necessary <br /> permits to allow for construction of the Joint Roadwork Project. The District will reasonably <br /> cooperate with the City in obtaining such permits. <br /> 2. Construction Right-of-Entry. The District hereby grants to the City and <br /> its contractors the right to enter on District property (Snohomish Tax Parcel Number <br /> 29083200100100) as necessary for the purposes for the Joint Roadwork Project. If determined <br /> by either Party that any additional instruments for entry are needed (such as temporary <br /> construction easements or licenses), the District will grant the City and the City's contractors <br /> such instruments as necessary for the construction of the Joint Roadwork Project. <br /> C. Procurement. <br /> 1. Bidding. After approval of the Approved Plans and Specifications, and <br /> the receipt of all necessary permits for the Joint Roadwork Project, the City will call for bids. <br /> The Joint Roadwork Project will be bid in a single bid separated into two schedules, one for the <br /> City portion ("Schedule A") and one for the District portion ("Schedule B"). The bid package <br /> will contain a provision that in substance states the following: <br /> "Bid items in Schedule A is work related to City property and will be paid for from City <br /> funds. Bid items in Schedule B is work related to Snohomish County PUD property and <br /> will be paid to Contractor by the City,but the City will be reimbursed from PUD funds. <br /> Accordingly, it is important that your bid be balanced between the schedules: if a line <br /> item on Schedule A is similar to a line item on Schedule B, then your bid prices for those <br /> line items on each schedule must be similar. The purpose of this is to make sure that <br /> PUD funds are not subsidizing City work or vice versa. The City reserves the right to <br /> reject any bid that is not balanced. <br /> The low bidder is the bidder with the lowest total bid, which is the sum of Schedule A <br /> and Schedule B." <br /> 2. Construction Contract. The City will execute a construction contract for <br /> the Joint Roadwork Project with the lowest responsive and responsible bidder in accordance with <br /> the City's usual procurement processes and the City's standard form construction contracts. The <br /> District will be added as an additional insured on the contractor's required liability insurance <br /> policies. <br /> D. Construction of Schedule B Work. <br /> 1. Construction and Inspection. The City will complete the Schedule B work <br /> in accordance with the Approved Plans and Specifications, as may be revised by change orders <br /> in accordance with Section 1.D.2 below. The City will be lead on the project and will <br /> coordinate all on-site inspection, i.e. providing a single point of contact for the Contractor. All <br /> direction to the Contractor for work on City and District property will go through the City's <br /> representative. The City and the District will cooperate so that the District's observation and <br /> inspection does not hinder, restrict or delay the Joint Roadwork Project. The District may attend <br /> all construction meetings. <br /> 2 <br />
