Biringer Shoreline Substantial Development application Dear Denny : I have reviewed the City of Everett Notice of Application for applicant Karl J. Biringer to fill 20 to 24 acres of a 32 acre site to an elevation two feet above the 100-year flood level and develop a business park on Spencer Island, north of Union Slough between I-5 and Highway 99 North. Although the City of Everett annexed this site from the County one year ago , the City has not developed and adopted their own shoreline designation or Master Program regulations and policies for this site. Therefore, we presume the County ' s Shoreline 'Master Program would be used when reviewing the application. My comments and concerns are itemized below. 1 . The application has not provided all the information required by the Shoreline Master Program. This proposal is for a landfill and subsequent construction of a business park. As such, these should be considered concurrently under one application. The attachment to the Biringer Environmental Checklist states that : 1. the exact nature of the fill material and method for handling the material will be determined -at the time the material becomes available; and 2. the specifics of the business park development are not intended to be a part of this application and further environmental analysis of the final development plan should occur prior to construction. Until all of the details of a . proposal are known, I question the ability to comply with the policies and regulations of the Master Program and to make an informed, knowledgeable decision on the proposal . If the necessary information is currently not available, perhaps it would be more appropriate to place the application on hold until the needed information is available. 2 . Specifically, as stated on pages F-35 and F-36 , applications which include landfilling must include the following information :
