the Port of Everett South Terminal, within the East Waterway, then south of the Naval Station Everett piers; then on the west side of Naval Station Everett following the Washington State Side Harbor line; then following the west boundary of Parcel F1, the west boundary of the Land Use and Occupancy Area, and the northern boundary of the Land Use and Occupancy Area to the northwest corner of Parcel D1 as shown on the Record of Survey for US Navy recorded under Snohomish County Auditor's File No. 200811125002; The Southeast: Beginning at the southeastern point shown as "End of M-2 Boundary as of 9/1/2015" on Exhibit 2, then following the westerly right of way line of the Burlington Northern Railroad right of way to the True Point of Beginning described above. SECTION 5: Page 1 of Exhibit 1 to Ordinance No. 2705-03 and Page 3 of Exhibit 1 to Ordinance No. 2706-03 are hereby replaced with Exhibit 1 pages 1 and 2 respectively to this Ordinance. SECTION 6: Severability. Should any section, paragraph, clause or phrase of this Ordinance or its application to any person or circumstance be declared unconstitutional or otherwise invalid for any reason, or should any portion of this Ordinance be pre-empted by state or federal law or regulations, this shall not affect the validity of the remaining portions of this ordinance or its application to other persons or circumstances. SECTION 7: Conflict. In the event there is a conflict between the provisions of this Ordinance and any other City ordinance, the provisions of this Ordinance shall control. SECTION 8: Corrections. The City Clerk and the codifiers of this Ordinance are authorized to make necessary corrections to this Ordinance including, but not limited to, the correction of scrivener's/clerical errors, references, ordinance numbering, section/subsection number and any references thereto. 7
