approved by the City that enhance safety and privacy (both for common open space and <br />dwelling units). <br />(e) Space should be oriented to receive sunlight, facing east, west, or (preferably) <br />south, when possible. <br />An example of on-site open space for multifamily uses that includes street -level <br />courtyards and private balconies. <br />(2) Balconies: Individual balconies or ratios may be used to meet un to 50 percent of <br />the required open space. To aualifv as open space, balconies or patios shall be at least 35 <br />square feet, with no dimension less than 4 feet, to provide a space usable for human <br />activity. <br />(3) Rooftop decks: Mav be used to meet up to 50 percent of the required open space, <br />provided following conditions are met. <br />(a) Space must be accessible (ADA) to all dwelling units. <br />(b) Space must provide amenities such as seating areas, landscaping, and/or other <br />features that encourage use as determined by the City. <br />(c) Space must feature hard surfacing appropriate to encourage resident use. <br />(d) Space must incorporate features that provide for the safety of residents, such as <br />enclosures and appropriate lighting levels. <br />b. Setbacks/Privacy. All ground floor residential units shall be set back at least 10 <br />feet from the public right of way, or, all living areas with windows shall have a floor <br />elevation at least 3 feet above the street grade to provide for increased privacy. The City <br />may approve other design solutions that retain resident privacy while enhancing the <br />pedestrian environment on the sidewalk. <br />
