Decision: Following review of the application materials and the Shoreline Master <br /> Program regulations, the Planning Director finds the proposal consistent with the SMP <br /> and the Shoreline Management Act and therefore approves the Shoreline Substantial <br /> Development Permit, subject to compliance with the following conditions of approval: <br /> 1. Construction permits, inspections, and final approvals are required for this project <br /> from City of Everett Permit Services. <br /> 2. A Public Works Permit is required for this project. Detailed drawings in accordance <br /> with the current City of Everett Design and Construction Standards and <br /> Specifications for Development shall be submitted to the Public Works Department, <br /> showing all proposed site landscaping, storm drainage, temporary construction <br /> erosion and sedimentation control (TESC), grading, and paving, as applicable. <br /> Public Works Department approval of these drawings is required prior to any permits <br /> being issued. All improvements shall be completed and approved prior to final <br /> approval from the City's Public Works Inspector. <br /> 3. The construction plans may be required to be designed from a site survey pertormed <br /> by a licensed State of Washington land surveyor. <br /> 4. Temporary erflsion control measures for construction activity must be operational <br /> prior to commencement of any clearing or earthwork. <br /> 5. Any grading/fill on this site shall be done so as to not impact the surrounding <br /> properties. <br /> 6. The plans submitted with the land use application show areas where compost will be <br /> used to amend the soils adjacent to the trail. Because recent studies have indicated <br /> that compost leaches phosphorus during its first two or three years of application, <br /> and phosphorus fuels algae growth in Silver Lake, compost amendments should not <br /> be used on this site. <br /> 7. The crushed stone pathway should be sloped to prevent the concentration of runoff <br /> along its length. It should be sloped gently towards the side of the path in order to <br /> provide even distribution of any runoff to the areas adjacent to the path. Any areas <br /> where runoff concentr'ates and begins to create erosion shall be immediately <br /> stabilized to prevent sediment deposition to the lake. <br /> 8. Any broken or damaged sidewalk/ public right-of-way that occurs due to construction <br /> of this site shall be repaired/ replaced in accordance with current City of Everett <br /> Standards and per the City Public Works Inspector. <br /> 9. If anything of possible archaeological interest is uncovered during excavations, the <br /> applicant must immediately stop work and notify the city and the Tulalip Tribes, and <br /> consult with a professional archaeologist who must inspect and evaluate the site. In <br /> the event that ground disturbing or other constructing activities result in the <br /> inadvertent discovery of the archaeological resources, work shall be halted in the <br /> immediate area, and contact made with the City of Everett, the office of the State <br /> Archaeologist (OAHP), and cultural resources office of the affected Tribes. Work <br /> must be halted until such time as further investigation and appropriate consultation is <br /> concluded. In the unlikely event of the inadvertent discovery of human remains, <br /> work shall be immediately halted in the discovery area, the remains covered and <br /> 4 <br /> r <br />
