i <br />.771 <br />I <br />DECLARATiuN OP' JOINT EASEMENT, COVENANTS AND RESTRICTTONS � <br />i <br />This Declaration of Joint Easement, Covenants and Restrictions <br />1 is made this day of 199P by Jack A. Giddens, as <br />his separate estate, owner of the real estate affected hereby, and <br />declares and states as follows: <br />1. The undersigned is the sole owner as his separate <br />property of that certain real property situate in Snohomish County, <br />state of Washington, described in Schedule 1 hereto attached as the <br />"Entire Parcel." <br />2. The undersigned is in the process of securing from the <br />City of Everett a Binding Site Plan - City of Everett #2-90 of said <br />Entire Parcel so that it consists of two lots, being lots A and B. <br />The legal descriptions of lot A and lot B upon completion of the <br />Binding Site Plan - City o� Everett #2-90 is set forth in Schedule <br />1 attached hereto as "Legal Description of Lot All and "Legal <br />Description of Lot B." <br />3. The undersigned herewith declares that an "Access, <br />Parking, and Utility Easement" (hereinafter referred to as the <br />"Joint Easement") is herewith created, to be effective upon the <br />completion of the Binding Site Plan - City of Everett #2-90, and <br />that the legal description thereof is set forth in Schedule 1 and <br />designated "Access, Parking, and Utility Easement (Joint <br />1 Easement)." The configurations of Parcels A and B, and of the <br />Joint Easement, are further illustrated by the sketch attached <br />j hereto as Exhibit A and by this reference made a part hereof.
