An HET staff person will be on duty during the entire time of the rental.The User is responsible for the conduct and behavior of the group using the facility.Costs for any needed call for security due to unruly behavior during an event by HET will be deducted from security deposit. If this deposit is insufficient to the infraction immediate restitution is required. HET reserves the right to limit the number of people entering the building or on any floor for safety reasons and crowd&parking control.This includes, but is not limited to: all hallways,entryways,and aisles. HET reserves the right to discipline, refuse entry,and/or eject anyone who may be putting themselves or anyone else in harm's way. HET and its designees shall have the right to enter the Facility at any time during its use by User. If HET staff determines that anything is going on that is not appropriate,or unlawful,at any time in any location in Theatre the staff can tell the people to stop and the infraction must stop immediately. Any designated HET person has this right and their authority must be respected and their decisions adhered to. If need be, authorities may be contacted. User, or a guest or other person under the User's control,shall not engage in any act intended to facilitate criminal activity, including drug-related criminal activity,on or near the Facility. Weapons are not allowed on the property.Adult supervision of children under the age of 16 is required at all times. Depending on the type of event,the User may be asked to provide additional security. If User is anticipating over 300 people for their concert or event—they may be asked to provide TWO additional security personnel. Since it is the best interest of Theatre to create a safe and enjoyable environment— Theatre can help arrange that security, but the user still has to pay for it. HAZARDOUS MATERIALS User shall not cause or permit the storage,use,generation or disposition of any Hazardous Materials(as hereinafter defined) at the Facility without the prior written consent of HET. User agrees to indemnify, defend and hold harmless the HET from all fines,suits, procedures,claims and actions of every kind, and all costs as attorney's'and consultant's'fees) arising out of or in any way connected with User's violation of this provision. User's obligations and liabilities under this Section shall survive the expiration or termination of this Agreement. For purposes of this Agreement,the term "Hazardous Materials" means any explosives,fireworks, radioactive materials or any other hazardous substances. Indemnification of Landlord Indemnification of Landlord: Landlord shall not be liable for any loss or injury to persons or damage to property, in or about the Premises,from any cause,which at any time may be suffered by Tenant or by its invitees or employees or agents, except to the extent said damage is caused by the willful misconduct of Landlord, its employees and its agents, harmless from any and all claims and expenses, including 26
