'7 <br /> a <br /> reasonable attorney's fee and costs, and litigation-related expenses arising out of said injury or damage, <br /> however occurring, on or about the Premises. <br /> MUSIC <br /> Because HET is located near a residential area,we ask that the decibel level be kept to a reasonable <br /> level of 110 decibels at the back of the house from the nearest speaker or sound source and that the <br /> music end by midnight.Complaints by neighbors may result in music volume reduction and fines. <br /> COMMON AREAS <br /> Common Areas:Common areas, if any,for use by Tenant, its employees,agents,customer and invitees <br /> include parking areas and entrances and exits thereto, driveways and alleyways,sidewalks, landscaped <br /> areas and other areas and facilities provided for the common use and benefit of occupants. In many <br /> cases this may mean the Balcony and Loge sitting areas depending on type of rental. Landlord reserves <br /> the right to exercise reasonable control and management of the common areas and to establish, modify, <br /> change and enforce such reasonable rules and regulations as Landlords, in their sole discretion may <br /> deem desirable for the management of the Premises or any portion thereof. Landlord shall have the <br /> right to close all or any portions of the common areas, balconies and Loge at such times and for such <br /> periods as may, in the opinion of the Landlords, be necessary. Landlord may also close said areas for <br /> purposes of maintenance and repair as well as Landlord personal use and for the good of Theatre,which <br /> would be determined at Landlords sole discretion. <br /> Building Costs and Heating and Air Condition:The cost of repairing the equipment provided by Landlord <br /> such as, but not limited to;heating and lights, light boards,sound and other equipment that is solely <br /> owned by Theatre other equipment on the premises will fall upon the renter that damaged said <br /> equipment.All property shall be inspected and signed off on prior to occupancy for each rental period to <br /> assure proper working order. <br /> CLEAN UP <br /> All food and beverage debris,decorations,supplies and other trash must be picked up, bagged and <br /> removed from the property by the User/Contracted Caterer or Bartender.The Facility must be left in an <br /> orderly condition. Failure to complete any of these tasks will result in a partial/complete loss of Security <br /> Deposit.The HET manager on duty will perform a walk-through of the premises prior to dismissing the <br /> caterer. HET is not responsible for any items left behind by User or its guests and HET may dispose of <br /> those at will within 14 days of the event. <br /> Tenant shall,at its own expense,at all times keep the Premises in good repair and attractive condition <br /> and maintained. If the Tenant does not make repairs promptly and adequately,or fails to maintain the <br /> Premises in good condition and repair, HET may make repairs and Tenant shall pay promptly the <br /> reasonable cost thereof.The right of HET to make such repairs shall be without prejudice to any rights it <br /> may have because of Tenant's failure to make such repairs. <br /> SURRENDER OF PREMISES <br /> 27 <br />
