1 RESOLUTION NO.o?c <br /> 2 <br /> A RESOLUTION setting forth Findings, Conclusions, and Final Decision <br /> 3 of the City Council in the matter of the application of Bolser <br /> Enterprises, Inc., for approval of a rezone with contract - <br /> 4 Rezone #5-81. <br /> 5 <br /> 6 WHEREAS, this matter having come on for public hearing on the 9th day of <br /> 7 February, 1983, upon the application of Bolser Enterprises, Inc., for approval of a <br /> 8 rezone with contract; and <br /> 9 WHEREAS, the City Council of the City of Everett has considered the Findings, <br /> 10 Conclusions and Recommendations of the Hearing Examiner of the City of Everett in <br /> 11 this matter dated February 2, 1983, submitted by memorandum of February 3, 1983; and <br /> 12 WHEREAS, at the public hearing the Council heard additional testimony and <br /> 13 statements from the City Planning Staff and proponents and opponents of the <br /> 14 application and further considered the exhibits, legal memorandum and arguments <br /> 15 offered by all interested parties; and <br /> 16 WHEREAS, the City Council finds that all interested parties have had an <br /> 17 opportunity to be heard and that the Council is fully informed in the premises; <br /> 18 <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> 19 <br /> OF EVERETT that the City Council shall hereby enter its Findings and Conclusions in <br /> 20 <br /> this matter as follows: <br /> 21 <br /> 22 <br /> FINDINGS OF FACT <br /> 23 <br /> 24 1. The City Council adopts all Findings of Fact made by its Hearing <br /> 25 Examiner in this matter which are not inconsistent with the additional findings made by <br /> 26 the City Council as further set forth herein. <br /> 27 2. That in recent history certain improvements have been made to the <br /> 28 residential properties in the neighborhood adjacent to the proposed rezone area which <br /> 29 tend to upgrade and preserve the neighborhood for residential use. <br /> 30 3. That the rezone area and adjacent properties continue at this time to <br /> 31 function as a viable residential neighborhood. <br /> 32 <br />
