CITY OF EVERETT, WASHINGTON <br /> RESOLUTION NO. /,,j-9 <br /> A RESOLUTION of the City Council of the City <br /> of Everett, Washington, accepting a majority <br /> petition and declaring its intention to order the <br /> improvement of an unnamed arterial street <br /> commonly known as 77th Street or Ella C. Ross <br /> Drive by the construction of a 40-foot wide <br /> street; curbs and gutters; sidewalks on the <br /> northeast side,and on the Southwest side from a <br /> point 199.98 feet east of Evergreen Wayyight-of- <br /> way west, a storm drainage system; traffic signal <br /> system at Evergreen Way; and a street lighting <br /> and underground wiring system; a 12-inch water <br /> main from Evergreen Way to Casino Road; a <br /> Regional Storm Detention System; property <br /> acquisition and necessary appurtenances as <br /> determined by the City Engineer in connection <br /> therewith and to create a local improvement <br /> district to assess the cost and expense of <br /> carrying out such improvement against the <br /> properties specially benefitted thereby, and <br /> notifying all persons who desire to object to the <br /> improvements to appear and present their <br /> objections at a meeting of the City Council to be <br /> held on September 15, 1982, at 8,3D a.m. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT, <br /> WASHINGTON, as follows: <br /> Section 1: A petition has been received to create a local improvement <br /> district to construct and install a certain improvement within the City, signed by <br /> 100% of the property owners of the area of property within the proposed district, <br /> and the City Council finds that the petition is sufficient under the law. <br /> Section 2: R.C.W. 35.43.040 provides that the legislative authority of a <br /> City may order a local improvement district. <br /> Section 3: It is the intention of the City Council of the City of Everett, <br /> Washington, based partially on such petition and based on R.C.W. 35.43.040, to <br /> order the improvement of the following property: <br /> Beginning at the center of Section 7, Township 28 North, Range 5, EW M, <br /> Thence South along the North-South center section line to its intersection <br /> with the northernmost corner of Lot 8 Block 4 Beverly Home Tracts Division <br /> Number 1 according to the Plat thereof recorded in the records of the <br /> Snohomish County Auditor; thence Southeasterly along the eastern lot <br /> line of said Lot 8 to the easternmost corner of said Lot 8 and intersecting <br /> the north right-of-way line of East Casino Road to a point 60.00 feet <br /> Southwest of the North-South center section line of said Section 7 as measured <br /> perpendicular to the North-South center section line to the West right- <br /> of-way line of an unnamed street commonly known as 77th Street S.E. <br /> or Ella C. Ross Drive; thence North and West following the West and south <br /> right-of-way line of said unnamed street a distance of 100.02 feet; thence <br /> N33°35'15" E a distance of 480.00 feet; thence N56°24'45" W a distance <br /> of 199.98 feet to the east right-of-way line of said Evergreen Way; thence <br /> Northeasterly along the east right-of-way line of said Evergreen Way to <br /> the south right-of-way line of 75th Street S.E.; thence Easterly along the <br /> south right-of-way line of said 75th Street S.E. to the northeast corner <br /> of Lot 1 Block 2 Beverly Home Tracts Division Number 2 according to <br /> the Plat thereof recorded in the records of the Snohomish County Auditor <br /> said point also being on the North-South center section line of said Section <br /> 7; thence South along the North-South center section line to the point of <br /> beginning; less that portion lying south of the north right-of-way line of <br /> said SR526. See Exhibit "A" attached. <br />
