I <br /> CITY OF EVERETT SPECIAL PROVISIONS <br /> I <br /> Sections and subsections in the Special Provisions labeled under the headers with (****''`*) <br /> indicate City of Everett Provisions. <br /> I <br /> 1-01 DEFINITIONS AND TERMS <br /> 1-01.3 Definitions I Section 1-01.3 is amended by adding the following: <br /> All references in the Standard Specifications to the terms "State", "Department of <br /> Transportation", "Washington State Transportation Commission", "Commission", I"Secretary of Transportation", "Secretary", "Headquarters", and "State Treasurer" shall <br /> be revised to read "City." <br /> All references to "State Materials Laboratory" shall be revised to read "City designated <br /> I <br /> location." <br /> Additive: A supplemental unit of work or group of bid items, identified separately in <br /> the Proposal, that may, at the discretion of the City, be awarded in addition to the base <br /> Bid. <br /> Alternative or Alternate: One of two or more units of Work or groups of bid items, <br /> identified separately in the Proposal, from which the City may make a choice between <br /> I <br /> different methods or material of construction for performing the same Work. <br /> Award Date: The date of the formal action by the Everett City Council to accept the <br /> lowest responsible and responsive Bidder for the Work. I <br /> Bid Documents: The component parts of the proposed Contract which may include, <br /> but are not limited to, the Proposal Form, the proposed Contract Provisions, the <br /> proposed Contract Plans, and Addenda. <br /> I <br /> Bid Opening Date: The date the Everett City Clerk publicly opens and reads the Bids. <br /> Change Order: Reference to Change Order shall include all rights of the City and <br /> I <br /> Contractor under 1-04.4 CHANGES. Agreed Change Orders shall be in the form <br /> attached as Exhibit 1. Unilateral Change Orders shall be in the form attached as <br /> Exhibit 2. <br /> Completion Date: Date on which Project is ready for Final Acceptance. All physical <br /> I <br /> work, including Punch List, is complete and Contractor has completed and fulfilled all <br /> contractual obligations except any maintenance of landscaping. Contractual <br /> obligations that must be fulfilled prior to achievement of the Completion Date include, <br /> I <br /> but are not limited to, the Contractor's furnishing all documentation, including correct, <br /> complete and accurate as-built or record drawings and operation and maintenance <br /> manuals and transfer of warranties. (This definition replaces the definition in WSDOT I 1-01.3 for Completion Date.) <br /> • Contract: Written agreement signed between the Owner and Contractor and includes <br /> Division C — CONTRACT, Division P - PROPOSAL, Division B — BID ITEM <br /> I <br /> DESCRIPTIONS, Special Provisions, Contract Plans, Standard Specifications and <br /> amendments, Standard Plans in effect as of the date Bids are opened, Addenda, <br /> supplemental agreements, change orders, certifications and affidavits required by this I Contract and by law, and Federal requirements that apply to this Contract and Project. <br /> (This definition replaces the definition in WSDOT 1-01.3 for Contract.) <br /> Contract Bond(s): Include a separate performance bond and payment bond, as set , <br /> forth in the Contract Documents. <br /> Contract Claim: Any request by the Contractor for additional time or money resulting <br /> in adjustment of Contract Sum or Contract Time irrespective of the cause or reason for <br /> I <br /> Sewer Regulators R4 and Division 1 —GENERAL REQUIREMENTS May 2017 <br /> R39 Modifications <br /> WO No—UP3633 SP-42 <br /> I <br />
