I <br /> CITY OF EVERETT SPECIAL PROVISIONS <br /> 1 <br /> DIVISION 8 MISCELLANEOUS CONSTRUCTION <br /> 1 8-12 Chain Link Fence and Wire Fence <br /> 8-12.2 Materials-Catalog Cuts or Standard Plans <br /> I 8-13 Monument Cases <br /> 8-13.2 Materials-Standard Plans <br /> Deviations from Standard Plans will be subject to a shop drawing submitted by the <br /> I Contractor and approved by the Engineer. Where a shop drawing is required by the <br /> Specifications, related Work performed prior to completion of the Engineer's review of <br /> the pertinent submission will be the sole expense and responsibility of the Contractor. <br /> I Supplement 1-05.3 by adding the following: <br /> 1-05.3(1) Submittals <br /> (******) <br /> I Where required by the Contract Documents, the Contractor shall submit information <br /> that will enable the City's Representative to advise the City whether the Contractor's <br /> proposed materials, Equipment or methods of work are in general conformance to the <br /> I design concept and in compliance with the drawings and Specifications, such as <br /> catalog cuts and shop, working or detail drawings. Approval or acceptance of a <br /> Submittal does not relieve Contractor from complying with Contract requirements. The <br /> I City's approval of a Submittal does not constitute a waiver of the Contract <br /> requirements. The City will not be obligated to accept or pay for Work performed by <br /> the Contractor that may be affected by materials, Equipment, or methods of work not <br /> I submitted in a timely manner so that final review can be accomplished before the <br /> affected Work is complete. The City shall not be responsible for Delays, inefficiencies, <br /> or any additional costs or expenses caused in whole or in part by Contractor's failure to <br /> submit required information in sufficient time for review, comment, and correction. <br /> I Contractor's failure to submit required information in sufficient time for review, <br /> comment and correction shall be deemed a waiver of any and all Contract Claims for <br /> adjustment of Contract Sum or Contract Time arising out of, or related to, such a <br /> I Submittal. Contractor acknowledges and agrees that it may not rely upon receiving the <br /> City's response to a Submittal in less than fourteen (14) calendar days, unless the City <br /> explicitly changes this section by a signed Change Order. <br /> I 1-05.3(2) Requests for Information <br /> (******) <br /> Requests for information or clarification from the Contractor to the City shall be treated <br /> Ias a Submittal pursuant to 1-05.3(1) SUBMITTALS. <br /> 1-05.4 Conformity With and Deviations From Plans and Stakes <br /> I Delete all of 1-05.4 and substitute the following: <br /> The Contractor shall be responsible for setting and maintaining all alignment stakes, <br /> slope stakes, and grades necessary for the construction of the roadbed, surfacing, <br /> I paving, channelization, illumination, signing, bridges, and retaining walls, if such <br /> construction is included in this Project. Except for the survey control data to be <br /> furnished by the City, calculations, surveying, and measuring required for setting and <br /> maintaining the necessary lines and grades shall be the Contractor's responsibility. <br /> I The Contractor shall provide the City with copies of such calculations and staking data <br /> when requested by the Engineer.
