CITY OF EVERETT <br /> VIOLATIONS HEARING EXAMINER <br /> City of Everett, a Washington ) <br /> Municipal Corporation, ) Case No. 08-0138 <br /> Petitioner, ) ORDER ON POST <br /> HEARING MOTION <br /> VS. ) TO AMEND <br /> Peter Popov ) <br /> 4841 Glenwood Ave. ) <br /> Everett, WA 98203 ) <br /> Respondent. ) <br /> This matter having come before the Violations Hearing Examiner on April 24, 2008, and <br /> the testimony of witnesses having been heard and all exhibits admitted in evidence <br /> having been considered, the Violations Hearing Examiner issued Findings, Decision, and <br /> Order(Order)on the violation on April 28, 2008. <br /> The Order required Peter Popov(Respondent) to (paraphrased): retain a professional <br /> engineer;submit plans for abatement; and to submit and adhere to a timeline for <br /> abatement of two improperly constructed retaining walls built on his residential property <br /> at the address above in violation of International Residential Code at Sections R109.4 and <br /> R113.2, and the International Building Code at Sections J108.3 and Section J109.4. Both <br /> International Codes have been incorporated and adopted by reference in the Everett <br /> Municipal Code at EMC 16.01.030. The collapse of one of the walls resulted in <br /> significant property damage and damage from uncontrolled drainage to neighboring <br /> properties. <br /> To date,the Respondent has not abated the improperly constructed wall or the collapsed <br /> wall,which failed on October 27,2007, causing drainage problems that continue to the <br /> present. <br /> Order on Post Hearing Motion to Amend <br /> Everett Violations Hearing Examiner <br /> Popov NOV-0-0138 page 1 of 2 <br />
