installed on either 2 inch metal pipes, for private property, <br /> or treated 4 inch by 4 inch wood posts, for public property, <br /> and shall be located so that the bottom of the sign is a <br /> minimum of 7 feet above the curb. Where fire lanes are <br /> adjacent to buildings or structures and when approved or <br /> directed by the fire code official, the signs may be placed <br /> on the face of the building or structure. <br /> 6. Where directed by the fire code official, specific areas <br /> shall be designated and those areas are to be marked with <br /> diagonal striping across the width of the fire lane. <br /> Diagonal marking shall be used in conjunction with painted <br /> curbs and/or edge striping and shall run at an angle of 30 to <br /> 60 degrees from one side to the other. These diagonal lines <br /> shall be in red traffic paint, parallel with each other, at least <br /> 6 inches in width, and 24 inches apart. Lettering shall <br /> occur as with'Type I marking. <br /> 503.3.1 Alternate materials and methods. The fire Code <br /> Official may modify, on a case-by-case basis, any of the <br /> marking provisions in this subsection 503.3 where practical <br /> difficulties exist. Modification requests shall be submitted <br /> in writing to the fire code official setting forth a suggested <br /> alternative. <br /> 6. The respondent has neither installed signs nor marked the fire lane turn around area on his <br /> property and the fire code official has not modified any of the marking provisions for the <br /> property, which is a violation of EMC §I 6.03.060(D). <br /> 7. The Violation Hearing Examiner has jurisdiction to hear this matter under EMC §16.03.040(x). <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law read into the record at the July 2, 2009, hearing of the <br /> above matter,the following Order is issued: <br /> I. Respondent Mr. Peter Popov shall be fined$1,500.00, for violations of the Chapter 16.01 EMC, <br /> occupancy of a structure without a certificate of occupancy; EMC §16.03.060(D), unmarked fire lane <br /> turn around area; and EMC §I 6.03.060(C), lack of a usable fire apparatus access road turn-around area <br /> on the property at 4841 Glenwood Avenue, Everett, Washington. <br /> 2. Peter Popov shall abate all violations listed in Section 1 of this Order by September 15, 2009. The <br /> respondent must also complete the following corrective action by the date specified to show his progress <br /> toward complete abatement: <br /> a. Vacate the dwelling by September 15, 2009 if Mr. Popov has not complied with <br /> subsections b and c of this section.. The dwelling may not be occupied by any person <br /> until the Building Official has issued a certificate of occupancy. To obtain a certificate of <br /> occupancy the Respondent must comply with subsections b-c of this Section. <br /> Compliance with these subsections in no way relieves the Respondent of his obligation to <br /> comply with any other codes or regulations prior to receiving the certificate of <br /> occupancy; <br />
