I 1 1 <br /> b. Complete work necessary to comply with EMC §16.03.060(C), in accordance with <br /> approved plans and permits, by September 1, 2009. Work is deemed complete when it <br /> has been inspected and approved by the City. The City will conduct its inspection within <br /> 5 business days of the respondent's request; and <br /> C. The fire lane turnaround must be marked in accordance with paragraphs 4 and 6 of EMC <br /> § 16.03.060 (D)by September 15,2009. <br /> 3. Mr. Peter Popov shall not violate any ordinance set forth in EMC 1.20.020 or any ordinance or <br /> regulation that identifies the enforcement procedure described in Chapter 1.20 EMC as the enforcement <br /> procedure for said regulations or ordinance,for the next twenty-four(24) months. <br /> 4. Mr. Peter Popov shall pU the$1,500.00 fine imposed in paragraph 1,above,no later than September <br /> 16, 2009 if the work required in subsection 2 of this order is not completed. Successful completion of <br /> this work by September 15,2009 will result in a reduction of$750.00 in the amount due. The total fine <br /> of $750.00 will be due on September 16, 2009. Payment shall be made to the City of Everett Treasurer <br /> at 2930 Wetmore Suite 100, Everett Washington, 98201. If payment is not made on or before July 16, <br /> 2009,collection action will be taken,which may include assigning the debt to a collection agency <br /> pursuant to RCW 19.16.500. <br /> 5. This written Order shall be controlling over any conflicts with oral Orders issued at the Public Hearing. <br /> 6. If the owner fails to abate the identified violations as directed by this Order, the City of Everett is <br /> authorized to undertake and complete the abatement in conformance with the provisions of the Everett <br /> Municipal Code, Chapter 1.20, at the full expense of the owner and the City may act without further <br /> order or direction of the Violations Hearing Examiner. <br /> 7. An appeal of this Order must comply with the procedure set forth in Chapter 36.70C of the Revised <br /> Code of Washington. <br /> 8.
