s <br /> CITY OF EVERETT <br /> VIOLATIONS HEARINGS EXAMINER <br /> CITY OF EVERETT, a Washington <br /> Municipal Corporation NO. 08-0138 <br /> Petitioner, FINAL ORDER <br /> VS. <br /> Peter Popov <br /> 4841 Glenwood Avenue, Everett, WA <br /> Respondent. <br /> ORDER TO AMEND AND CLARIFY HEARING EXAMINER'S ORDER <br /> The Hearing Examiner, having reviewed the pleadings and other documents on <br /> file in this matter, having considered the foregoing Motion to Amend, and having <br /> determined that the Petitioner served the Respondent with notice of this Motion, issues <br /> the following order: <br /> 1. The Findings of Fact, Conclusions of Law and Order of the Hearing Examiner <br /> entered on April 28, 2008, (the "Order") in the above captioned matter are amended by <br /> inserting the following language immediately preceding Section 1 of the Order: <br /> "The Respondent shall abate all the violations of the EMC listed in the <br /> Conclusions of Law by September 1, 2009. Further, the following steps and <br /> conditions must be met to comply with this Order:" <br /> 2. The Order is amended by inserting the following language immediately after <br /> Section 3.f of the Order: <br /> "g. The collapsed ecology block retaining wall shall be replaced by a <br /> retaining wall that complies with the permit(s) received pursuant to <br /> subsection 3.b and 3.e of this Order and rectifies any deficiencies found <br /> pursuant to subsection 3.c of this Order by September 1, 2009.
