3. Mr.Popov caused an ecology block retaining wall to be built up with five rows of <br /> ecology blocks stacked on top of each other,without the approval of the building official. <br /> By building up the ecology block retaining wall to over eight feet in height,Mr. Popov <br /> exceeded the four feet height limit for retaining walls that would be exempt from permit <br /> requirements. Such action or omission constitutes a violation of the International <br /> Residential Code at Section R109.4,which has been incorporated and adopted by reference <br /> in the Everett Municipal Code(EMC 16.01.030), and states in relevant part: "Work shall <br /> not be done beyond the point indicated in each successive inspection without first <br /> obtaining the approval of the building official." <br /> 4. Mr. Popov caused an ecology block retaining wall to be built up with five rows of <br /> ecology blocks stacked on top of each other without obtaining engineering to adequately <br /> address issues such as drainage, erosion, and the stability of the wall and without the <br /> approval of the building official. The wall that was supposed to protect adjacent properties <br /> at the toe of the slope from the adverse effects of grading on Mr. Popov's property failed to <br /> protect the owners of the adjacent properties. Instead, a portion of that retaining wall <br /> collapsed on November 16, 2007, and blocks of the retaining wall tumbled onto Mr. <br /> Popov's neighbors' adjacent properties at the toe of the slope. These adjacent properties <br /> also experienced flooding and erosion of the ground in areas where water flowing from <br /> Mr.Popov's property discharged onto these adjacent properties. Such action and/or <br /> omission constitute a violation of the International Building Code at Section J108.3,which <br /> has been adopted and incorporated by reference in EMC 16.01.030, and states in relevant <br /> part: <br /> Where required to protect adjacent properties at the toe of a slope from adverse <br /> effects of the grading, additional protection, approved by the building official, shall <br /> be included. Such protection may include but shall not be limited to: 1. Setbacks <br /> greater than those required by Figure J108.1; 2. Provisions for retaining walls or <br /> similar construction; 3. Erosion protection of the fill slope; 4. Provision for the <br /> control of surface waters. <br /> 5. Mr. Popov's caused the ecology block retaining wall to be constructed taller than <br /> depicted in the architectural site plan submitted with the building permit application for <br /> improvements to his property.In the architectural site plan,the wall was depicted to be <br /> only four feet tall, leading the Building Division to believe the structure was exempt from <br /> permit. Instead,by May 2006,the retaining wall was built up to over eight feet in height, <br /> consisting of five rows of ecology blocks stacked on top of each other. By causing the <br /> ecology block retaining wall to be built up taller than the wall depicted in the architectural <br /> site plan submitted with the building permit application,Mr. Popov violated the terms of <br /> the original building permit issued for improvements to his property,which constitutes a <br /> violation of the International Residential Code at Section R113.2, which is adopted and <br /> incorporated by reference in EMC 16.01.030.
