r • <br /> moving, removal, demolition or occupancy of a building or structure in violation of <br /> the provisions of this [International Residential Code, or in violation of a detail <br /> statement or a plan approved thereunder or in violation of a permit or certificate <br /> issued under the provisions of this code. <br /> 6. In fall 2007,when Mr. Popov's engineer submitted an engineering detail, the wall was <br /> depicted to be four blocks tall(eight feet in height). Again,the wall as constructed was <br /> inconsistent with the materials submitted to obtain the permit approval of the building <br /> official. It is evident that Mitchell Engineering had not inspected the wall as constructed <br /> nor certified its compliance with codes. By causing the ecology block retaining wall to be <br /> built up taller than the engineering detail submitted in fall 2007, Mr. Popov again violated <br /> the International Residential Code at Section R113.2,which is adopted and incorporated <br /> by reference in EMC 16.01.030. <br /> 7. Mr. Popov caused an ecology block retaining wall to be built up with five rows of <br /> ecology blocks stacked on top of each other without adequately addressing, through <br /> engineering, issues such as drainage, erosion, and the stability of the wall. The properties <br /> adjacent to Mr. Popov's property experienced flooding and erosion of the ground in areas <br /> where water flowing from Mr.Popov's property discharged onto these adjacent properties. <br /> Such actions and omissions constitute a violation of the International Building Code at <br /> Section J109.4,which has been adopted and incorporated by reference in EMC 16.01.030. <br /> Section J109.4 states in relevant part: "Excess or concentrated drainage shall be contained <br /> on site or directed to an approved drainage facility. Erosion of the ground in the area of <br /> discharge shall be prevented by installation of non-erosive down drains or other devices." <br /> 8. Mr. Popov to date has failed to correct the above-referenced violations. <br /> 9. Pursuant to Chapter 1.20 of the Everett Municipal Code,the Violations Hearing <br /> Examiner has jurisdiction over this matter and parties. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law read into the record at the hearing <br /> on April 24, 2008, of the above matter,the following Order is issued: <br /> 1. Within five business days of the mailing of this Order,Peter Popov shall submit <br /> to the Everett building official a letter from an engineer licensed by the State of <br /> Washington stating: 1)that Mr. Popov has retained the engineer; and 2) that he/she <br /> will be the"Engineer of Record" for the correction of violations relating to the <br /> ecology block retaining wall and/or the retaining wall attached to the south side of <br /> the building on the 4841 Glenwood Avenue property; and 3) a statement of the <br /> scope of work for the"Engineer of Record,"which shall include: <br /> a. Preparation of a design for the repair of the partially collapsed ecology <br /> block retaining wall that would be appropriate for the site conditions and <br /> that would provide for drainage by approved methods. <br />
