3 <br /> ORDINANCE NO. <br /> An Ordinance Concerning the Zoning Regulations for Accessory Dwelling Units, <br /> Amending Section 7(J) of Ordinance No.3534-17(EMC 19.07.030.3) <br /> WHEREAS,the City Council finds the following: <br /> 1. The City Counciladopted Ordinance No. 3354-17 on February 15,2017; <br /> 2. The Ordinance amended the City's zoning regulations for Accessory Dwelling Units <br /> (ADU's) and specifically allowed for detached ADU's in single family zones; <br /> 3. The new regulations established a maximum floor area limit for ADU's as 800 square <br /> feet, or 75% of the floor area of the principal dwelling,whichever is less; <br /> 4. The new regulations did not include a mechanism for considering whether or not to allow <br /> a greater floor area for ADU's; <br /> 5. There may be circumstances where the existing floor area of a space within an existing <br /> building is greater than 800 square feet, or 75%of the floor area of the principal <br /> dwelling, and conversion of that space for an ADU with the floor area limitation does not <br /> allow for a logical or effective floor plan; <br /> 6. It is the City's intent to allow for ADU's as a secondary residence in single family zones <br /> in order to allow for additional housing opportunities in such areas, consistent with State <br /> law; <br /> 7. Providing for additional flexibility in the floor area limits for ADU's will allow <br /> homeowners the ability to create additional housing within existing building spaces in an <br /> efficient and cost-effective manner; and <br /> 8. The Planning Commission held a public hearing on April 4,2017,to consider the <br /> proposed amendment and did take public testimony concerning the merits of the <br /> proposed amendment <br /> WHEREAS,the City Council concludes the following: <br /> 1.
