1 RESOLUTION NO. /9 <br /> 2 <br /> A RESOLUTION declaring an emergency to exist and authorizing the <br /> 3 Building Official to secure and provide emergency repair for the <br /> building located at 2827 Norton Avenue. <br /> 4 <br /> 5 <br /> 6 WHEREAS, the City Council finds that the building which is located at 2827 <br /> 7 Norton Avenue contains the following deficiencies: <br /> 8 <br /> - the building is open to the public and there exists evidence that it <br /> 9 is being occupied by transients. <br /> 10 - there are make-shift beds set up in the structure. <br /> 11 - several large holes have been burned through the floor of the <br /> building. <br /> 12 <br /> - approximately 75% of the 2" x 6" studs have been removed from <br /> 13 the bearing walls which support the second and third floors of the <br /> building. <br /> 14 <br /> - the remaining studs show evidence of significant deflection, <br /> 15 indicating that the floors have started to settle. <br /> 16 - should the remaining studs collapse, the entire second and third <br /> floors, as well as the roof, could collapse injurying or killing <br /> 1.7 persons in and around the building; and <br /> 18 <br /> WHEREAS, the City Council finds that the condition of the building was brought <br /> 19 <br /> to the City's attention on July 23, 1981, and that a certified letter was sent to the <br /> 20 <br /> owner of the structure, Mrs. Johnnie Griffith, on the 24th of July, 1981; and <br /> 21 <br /> WHEREAS, the City Council finds that the owner received the letter and has <br /> 22 <br /> neither secured nor repaired the building, nor contacted the Building Official; and <br /> 23 <br /> WHEREAS, the City Council finds that the building is unsafe in its present state <br /> 24 <br /> and is a hazard to the health and safety of the general public; and <br /> 25 WHEREAS, the City Council finds that it is imperative that immediate action be <br /> 26 taken to secure and repair the structure; and <br /> 27 WHEREAS, the City Council finds that the normal abatement proceedings would <br /> 28 take too long to implement; and <br /> 29 WHEREAS, the City Council finds that the building is structurally unsound and <br /> 30 on the verge of falling down; and <br /> 31 <br /> 32 -1- <br />
