1 RESOLUTION NO. /9 2 A RESOLUTION declaring an emergency to exist and authorizing the 3 Building Official to secure and provide emergency repair for the building located at 2827 Norton Avenue. 4 5 6 WHEREAS, the City Council finds that the building which is located at 2827 7 Norton Avenue contains the following deficiencies: 8 - the building is open to the public and there exists evidence that it 9 is being occupied by transients. 10 - there are make-shift beds set up in the structure. 11 - several large holes have been burned through the floor of the building. 12 - approximately 75% of the 2" x 6" studs have been removed from 13 the bearing walls which support the second and third floors of the building. 14 - the remaining studs show evidence of significant deflection, 15 indicating that the floors have started to settle. 16 - should the remaining studs collapse, the entire second and third floors, as well as the roof, could collapse injurying or killing 1.7 persons in and around the building; and 18 WHEREAS, the City Council finds that the condition of the building was brought 19 to the City's attention on July 23, 1981, and that a certified letter was sent to the 20 owner of the structure, Mrs. Johnnie Griffith, on the 24th of July, 1981; and 21 WHEREAS, the City Council finds that the owner received the letter and has 22 neither secured nor repaired the building, nor contacted the Building Official; and 23 WHEREAS, the City Council finds that the building is unsafe in its present state 24 and is a hazard to the health and safety of the general public; and 25 WHEREAS, the City Council finds that it is imperative that immediate action be 26 taken to secure and repair the structure; and 27 WHEREAS, the City Council finds that the normal abatement proceedings would 28 take too long to implement; and 29 WHEREAS, the City Council finds that the building is structurally unsound and 30 on the verge of falling down; and 31 32 -1-
